Commissioner Hendriksen stated that the Comprehensive Plan drives thc' Zoning Ordinance and <br />that the Comnnss~on has struggled with inconsistencies m the Code. <br /> <br />Ma,,,or Gilbenson stated CUP's are a time consuming problem and if more specifics were laid <br />CU'P's wouldn't be necessary. He suggested aiding the Planing and Zoning Commission <br />making more specific guidelines. <br /> <br />Commissioner Deemer stated the City has a named exclusion type of zoning. <br /> <br />Commissioner Hendriksen stated he feels it is reasonable to allow conditional use permits and tha~ <br />he doesn't mind the time it takes. What bothers him is that the Commission spends ,'t lot of time on <br />a CUP to get it harmonious with the zoning district for which it is proposed and the applicant fails <br />to comply with the terms. He feels the Cit.',, has to have a way to enforce CUP terms. <br /> <br />Councilmember Peterson stated the City does not have the money in the budget to hire enough staff <br />to do follow-ups and enforcing. <br /> <br />Ms. Frolik stated "fires are always having to be put out" due to not having the staff members to do <br />the enforcing and not having the staff to plan for the future. She stated the only way to find out if <br />someone isn't in compliance with their CUP is through a complaint. When a con]plaint comes in, <br />it is verified and personal contact is made with the offender. A couple of letters are sent asking for <br />compliance and then it is brought to City Council for a Public Hearing. She stated raising <br />application rates decreases the number of CUP applications and if the City feels it use is not <br />compatible, it has to take a stand and deny it. <br /> <br />Motion by Councilmember Peterson and seconded b,,' Councilmember Bever to direct City Staff to <br />revise the CUP procedure and policy, increase fee, draft a disclosure as ~o what fees ,.,,,ill be <br />charged and present it to City Council for their review. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Beyer, Cich and <br />Hardin. Voting No: None. <br /> <br />Councitmember Hardin stated the City is looking for quality, well-planned development and must <br />follow a code and a comprehensive plan. He added that the Cir.`, Code may need to be changed. <br /> <br />Commissioner Deemer stated that once the Planning and Zoning Commission makes a <br />recommendation to Cfi.`, Council, Cit.`, Staff shouldn't be partisan to the issue. Cit.`, Staff should <br />point out and/or note if ~here is a conflict with Cit.`, Code, but the recommendation should stand. <br /> <br />Other members present indicated that it is acceptable for City Staff to offer a recomn]endation to <br />Cit,,' Council in addition to the Planning and Zoning Commissions recommendation. <br /> <br />Motion by Councilmember Hardin and seconded by Councilmember Cich to direct City Staff to <br />review the Comprehensive Plan and codification and' take steps to update where needed. <br /> <br />Motion carrA'ed. Voting Yes: Mayor Gilbertson. Councilmembers Hardin. Cich. Beret and <br />Peterson.
