COMMISSION BUSINESS <br /> <br />Case #1: Request for an Amendment to Conditional Use Permit; Case of <br /> Dannyts Aluminum, Inc. <br /> <br />Ms. Frolik stated that Mr. Karst is requesting an amendment to his conditional use permit to allow <br />disassembly of engines and transmissions on site. She stated an analysis of his conformance to the <br />current CUP is included in the materials submitted to the Commission. <br /> <br />The Commission proceeded to review the proposed Findings of Fact. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to amend ~ to read "That <br />the subject parcels total approximately five (5) acres in size". <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, Terry, Hendriksen <br />and LaDue. Voting No: None. Absent: Commissioners Bawden and Thorud. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to amend #18 to read <br />"That the proposed use will not substantially adversely impair the use .... " <br /> <br />Further discussion: Commissioner Deemer commented that the impairment has improved. Most <br />of the "junky conditions" in the area are not on the property in question. Commissioner Terry <br />commented this area is zoned Heavy Industrial. <br /> <br />Motion carried. Voting Yes: <br />Voting No: None. Abstain: <br />Thorud. <br /> <br />Chairman Zimmerman, Commissioners Deemer, Terry and LaDue. <br />Commissioner Hendriksen. Absent: Commissioners Bawden and <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to modify numbers 19 <br />through 25 in the affirmative manner. <br /> <br />Motion carried. Voting Yes: <br />Voting No: None. Abstain: <br />Thorud, <br /> <br />Cha/rrnan Zimmerman, Commissioners Deemer, Terry and LaDue. <br />Commissioner Hendriksen. Absent: Commissioners Bawden and <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to add 4/26 to read "No <br />documented violations have occurred since the last amendment to the conditional use permit. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Conunissioners Deemer, Terry and LaDue. <br />Voting No: Commissioner Hendriksen. Absent: Commissioners Bawden and Thorud. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to recommend that City <br />Council adopt a resolution accepting the findings of fact, as amended, relating to Danny's <br />Aluminum Processing, tnc.~s request for an amended conditional use permit. <br /> <br />Ms. Frolik outlined the differences in the existing CUP and the requested amendments to the CUP. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry that 4/7 should read "... <br />An afterburner unit shall be installed on each melt furnace no later than 120 days after PCA <br />approval of the test afterburner unit. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, Terry, Hendriksen <br />and LaDue. Voting No: None.
