6. PUBLIC HEARING <br />6.01: Public Hearing to Consider Request to Vacate a Portion of Drainage and Utility <br />Easement at 16205 Sapphire Street NW; Case of Scott Wold <br />Mayor Pro Tem Backous closed the regular portion of the City Council meeting at 7:04 p.m. in <br />order to conduct a public hearing. <br />Public Hearing <br />Mayor Pro Tem Backous called the public hearing to order at 7:04 p.m. <br />Presentation <br />Community Development Director Gladhill reviewed the staff report and recommendation to <br />vacate a portion of a drainage and utility easement at 16205 Sapphire Street NW to <br />accommodate the first phase of the Sweetbay Ridge subdivision. <br />Citizen Input <br />Jennifer Bennefeld, 16145 Rhinestone Street, stated her house is behind this lot and her concern <br />is that grading does not push water onto her yard. <br />Community Development Director Gladhill stated the City Engineer reviewed the drainage <br />calculations and determined it meets stormwater modeling of the Lower Rum River Watershed <br />District. It is a one -to -one replacement, or more, of the wetland. Given the size of the wetland <br />and area of grading, he stated it should not force drainage beyond the easement. <br />Motion by Councilmember LeTourneau, seconded by Councilmember Riley, to close the public <br />hearing. <br />Motion carried. Voting Yes: Mayor Pro Tem Backous, Councilmembers LeTourneau, Riley, <br />Johns, Kuzma, and Tossey. Voting No: None. Absent: Mayor Strommen. <br />The public hearing was closed at 7:08 p.m. <br />Council Business <br />Mayor Pro Tem Backous called the regular City Council meeting back to order at 7:08 p.m. <br />Councilmember Kuzma reported that the drainage calculations were reviewed by Barr <br />Engineering, the LRRWMO's consulting engineer, and found to be adequate. <br />Motion by Councilmember LeTourneau, seconded by Councilmember Johns, to Adopt <br />Resolution #14 -10 -221 Vacating a Portion of a Drainage and Utility Easement on Lot 12, Block <br />1, Sweetbay Ridge. <br />City Council / October 28, 2014 <br />Page 4 of 10 <br />
