6. PUBLIC HEARING 6.01: Public Hearing to Consider Request to Vacate a Portion of Drainage and Utility Easement at 16205 Sapphire Street NW; Case of Scott Wold Mayor Pro Tem Backous closed the regular portion of the City Council meeting at 7:04 p.m. in order to conduct a public hearing. Public Hearing Mayor Pro Tem Backous called the public hearing to order at 7:04 p.m. Presentation Community Development Director Gladhill reviewed the staff report and recommendation to vacate a portion of a drainage and utility easement at 16205 Sapphire Street NW to accommodate the first phase of the Sweetbay Ridge subdivision. Citizen Input Jennifer Bennefeld, 16145 Rhinestone Street, stated her house is behind this lot and her concern is that grading does not push water onto her yard. Community Development Director Gladhill stated the City Engineer reviewed the drainage calculations and determined it meets stormwater modeling of the Lower Rum River Watershed District. It is a one -to -one replacement, or more, of the wetland. Given the size of the wetland and area of grading, he stated it should not force drainage beyond the easement. Motion by Councilmember LeTourneau, seconded by Councilmember Riley, to close the public hearing. Motion carried. Voting Yes: Mayor Pro Tem Backous, Councilmembers LeTourneau, Riley, Johns, Kuzma, and Tossey. Voting No: None. Absent: Mayor Strommen. The public hearing was closed at 7:08 p.m. Council Business Mayor Pro Tem Backous called the regular City Council meeting back to order at 7:08 p.m. Councilmember Kuzma reported that the drainage calculations were reviewed by Barr Engineering, the LRRWMO's consulting engineer, and found to be adequate. Motion by Councilmember LeTourneau, seconded by Councilmember Johns, to Adopt Resolution #14 -10 -221 Vacating a Portion of a Drainage and Utility Easement on Lot 12, Block 1, Sweetbay Ridge.
