One of the <br />contingencies in the purchase agreement is city approval of our <br />application for use of the site. We wish to relocate our medical <br />transcription business, provide secretarial services and, subject <br />to state licensing approval, open a day care next spring. <br /> <br />The site is six acres in size, zoned R1R Rural Residential and <br />now contains a church of approximately 6,900 square feet. Our <br />request for Conditional Use Permit (CUP) asks for approval of our <br />proposed use as professional office and day care, and for the <br />ability to expand the building in a manner similar to that shown <br />on the original building permit approval in 1973. <br /> <br />City staff has been unable to locate any prior permit approvals <br />for the church, which requires a CUP today, and most probably did <br />as well in 1973. We possess copies of the original site and <br />building plans from 1973, which show future expansion on the <br />plans, and we believe that the Town Board approved the church <br />with full knowledge that the site would be more intensely <br />developed in the future. Please reference a copy of the 1973 <br />site plan, enclosed. <br /> <br />In addition to our request for City approval of our use, we wish <br />the CUP to grant us the right to add to the church building "for <br />professional office and day care consistent with the 1973 site <br />plan and our current permit approval." While we do not have any <br />current plans to expand the building, as contract purchasers we <br />need to be assured, prior to closing on the purchase, that we <br />have the ability to add to the building, subject to normal <br />building permit review. <br /> <br />17 <br /> <br /> <br />
