Case

ENDMENT OF ADULT USE NON-CONFORMING USE SECTION
OF ZONING CODE

By: William K. Goodrich, city Attorney

BACKGROUND:

In December, 1990, the City adopted several zoning ordinance
amendment~ which included Section 9.11.19, Subd. 5, which is a
section regulating non-conforming adult use principal or accessory.
In reviewing this section, staff has noticed that a line was
inadvertently omitted from this paragraph. In addition, this
paragraph! has certain timing requirements, one of which requires
notice to~ the owners of any non-conforming uses. This notice was
not given~ by the City within the required time frame. Therefore
to correct these two problems we are proposing the amendments as
shown in bold on the attached proposed language revision.

ENCLOSURE~:

1. Original subdivision 5, Chapter 9.11.19.
2. Proposed amendment to said subdivision 5.
3. Notice of public hearing published on October 25, 1991.

STAFF RECOMMENDATION:

To recommend that the city Council amend subdivision 5 as proposed.

PLANNING COMMISSION ACTION:

Motion to recommend that the City Council adopt the amendments to
Chapter 9i11.19, subdivision 5 entitled "Nonconforming Adult Use-
Principal or Accessory"

Review Checklist:

city Administrator
Zoning Administrator
CitylAttorney
