CASE <br /> <br />PROPOSED REZONINGS FROM I-INDUSTRIAL TO RI-RURAL INDUSTRIAL <br />AND B-1 ffUSINESS TO RB-RURAL BUSINESS; CASE OF CITY OF RAMSEY <br />By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />The City is in the process of updating it's Zoning Map. In doing so, it has come to our attention <br />that there arc,certain properties outside of the city's urban sewer service area that are not zoned <br />accordingly, The Ramsey City Code states that Rural Business (RB) and Rural Industrial (RI) <br />zoning is int4mded for commercial development outside of the city's urban sewer service area. <br />There are numerous parcels outside the urban sewer service area that are currently zoned B-1 <br />Business and l-Industrial, a zoning intended for commercial development within the urban sewer <br />service area. <br /> <br />The Planning and :Zoning Commission and the City Council has authorized City Staff to correct <br />this situation and initiate action to consider rezoning the subject properties from B-1 Business to <br />Rural Business and I-Industrial to RI-Rural Industrial. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br /> <br />c) <br />d) <br />e) <br /> <br />g) <br />h) <br /> <br /> Site location maps A, B and C depicting parcels to be rezoned <br />Sample letters sent to affected property owners notifying them of the pending <br />' rezonings <br /> Public Hearing Notice <br />i Properties Notified <br />:City Code sections B-1 Business, RB-Rural Business, I-Industrial and RI-Rural <br />~ Industrial <br /> Excerpts from City Code regarding Adult Uses <br /> Proposed findings of fact <br /> Proposed ordinance <br /> <br />ObservationS: <br /> <br />The most significant impact to properties being rezoned from I-Industrial to RI-Rural Industrial is <br />the loss of SuPply Yards and Athletic/Fitness Centers as permitted uses. By the way, we either <br />need to amenc~ our code to include a definition for Supply Yard that is other than open and outdoor <br />storage or we' should delete Supply Yard as a permitted use. I believe when zoning district <br />regulations w~re amended in 1990, the intent was that supply yards would from that point on <br />require a con{:litional use permit. However, in making that amendment, supply yards as a <br />permitted use Was inadvertently retained under permitted uses. At any rate, those parcels that are <br />rezoned to Rural Industrial and are currently utilizing their property for open and outdoor storage <br />would be considered lawful non-conforming and the use may continue. If the use ever ceases for <br />6 consecutive [months, it will require a conditional use permit to re-establish open and outdoor <br />storage as the t~se of the property. Newly developing properties in that area would be required to <br />obtain a conditional use permit to have open and outdoor storage as a principal use of the property. <br /> <br /> <br />
