CASE

i ADOPT ORDINANCE TO REZONE CERTAIN PROPERTY
FROM R-2 MEDIUM DENSITY RESIDENTIAL TO B-2 BUSINESS;
CASE OF SCOTT HAGEN.
By: Amy Geisler, Associate Planner

Background:

Scott Hagen (owner of Hi-Ten Sports) has requested that the City rezone his property south of
Highway 10,West of Llama Street from R-2 Medium Density Residential to B-2 Business.

The following~items are enclosed for your information:

a) Site location map
b) Exl{ibit showing property subject to rezoning
c) Proposed Ordinance

Notification:

State statute requires that property owners within 350 feet of the subject property be notified of
the public heaOng.

Observations:i

It appears that the subject property was inadvertently shown as Residential in the 2001
Comprehenstv~ Plan and subsequently zoned R-2 Residential. Along with changing the subject
property's Lar~d U~e designation back to Places to Shop, the parcel's zoning must also be
changed back tb B-2 Business.

The City CoUnCil conducted its first reading of the request for zoning amendment at its February.
10, 2004 meetii~g. The ordinance is now ready for adoption.

Recommendation:

The Planning Commission and City Staff recommend approval of the rezoning and waiver of the
Zoning Amendment application fee.
