Tha~t part of the Northeast Quarter of the Southwest Quarter of Section 28, Township 32, R,~nge 25, Anoka County, Minnesota, described as follows: Begirming at the point of intersection of the west line of said Northeast Quarter of the SbuthWest Quarter with the southerly right of way line of the Burlington Northern Railroad; thence southerly along said west line of said Northeast Quarter of the SOuthwest Quarter to its intersection with the northerly right of way line of U.S. High~ay No. 10; thence southeasterly along said northerly right of way line of said U.S/ ~Tmnk Highway No. 10 a distance of 485.00 feet to the actual point of begi~ing of the tract to be herein described; thence continuing along the northerly right Of way of said highway a distance of 140 feet; thence northerly to a point on said southerly right of way line of said Burlington Northern Railroad distant 691.80 feet sgutheasterly from the west line of the Northeast Quarter of the Southwest Quarter as measured along the southerly right of way of the Burlington Northern Railro~ad; thence northwesterly along said southerly right of way line Of said Burlidgton Northern Railroad a distance of 140 feet; thence southwesterly t}) the" point Of beginning. (the "Subject Property") NOW THERtgFORE, BE IT RESOLVED BY THE CITY COUNCIl., OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: ; 1) That the Applicant appeared before the Planning Commission for a public hearing pursua~ t t° Section 9.03.04 of the Ramsey City Code on February 5, 2004 and that the public 3heating was properly advertised and that the minutes of said public hearing are herebY, incOrporated by reference. 2) That the Subject Property is approximately 2.0 acres in size and is zoned B-2 Highway Business; the surrounding parcels are zoned B-2 Highway and E-2 Employment. 3) That Section 9.20.22 (B-2 Highway Business) of the Ramsey City Code states that motor vehi¢10 sales is a permitted use and all vehicle display areas, as well as custom, er/employee parking areas, must be surfaced with bituminous or concrete and the perimeter of said pavement must be finished with B6/12 concrete curbing. 4) 5) 6) That on December 22, 2003, the Applicants submitted a request for an Interim Use Permit to store and display auto and recreational vehicles on the Subject Property on an area that is absent of the required pavement and grading improvements due to weather conditions not being conducive to installing the requirement improvements. That the Applicants have stated they will be installing the required holding ponds, bttuminous pavement, and concrete curbing in the Spring of 2004 when the Weather conditions permit the installation of such improvements. That thc Applicants will be required to submit a grading and paving plan that is subject to the City Engineers approval prior to initiation of any paving and grading improvements on the Subject Property. 7) That the proposed improvements shall conform to the performance standards established in the B?-2 I--[ighway Business District.
