Voting No: None. <br /> <br />Case #3: Request for Comprehensive Plan Amendment; Case of Scott Hagen <br /> <br />Community Development Director Frolik explained the 2001 Comprehensive Plan shows the <br />parcel south of'Highway 10, immediately west of Llama Street, as Medium Density Residential. <br />A commercial iuse, Hi-Ten Sports, has been operating on the parcel for many years. In the <br />process of selling ~the property, the owner and staff became aware of the parcel's Medium <br />Density Residential land use designation. She explained the parcel was shown with a <br />Commercial laf~d use in earlier drafts of the Comprehensive Plan. Staff was unable to dete~rnine <br />the rationale roi changing the parcel's designation to Residential in the adopted Comprehensive <br />Plan. Staff fe~ls that the existing commercial use of the property is more compatible with the <br />other commercial uses to the east in Alpaca Estates rather than as a Medium Density Residential <br />use. Even tho~ugh it appears that the parcel's current designation is a technical eh'or, it was <br />shown as Medi~tm Density Residential in the 2001 Comprehensive Plan adopted by the Council. <br />Because of thi~, the applicant must apply for a Comprehensive Plan amendment and rezoning. <br />Staff and thei: Planning Commission recommend approval of the Comprehensive Plan <br />Amendment and to waive the application fee. <br /> <br />Counci hnember Elvig inquired if staff is aware of any other properties in this condition. <br /> <br />Community Development Director Frolik replied there are not any other properties that have <br />been brought t° s. taff's attention. <br /> <br />Motion by Cou~ncilmember Kurak, seconded by Councilmember Cook, to adopt Resolution #04- <br />02-042 identifying findings, approving a Comprehensive Plan Amendment to change a land use <br />designation from Medium Density Residential to places to shop, and authorize City staff to <br />submit an application to the Metropolitan Council for an amendment to the Comprehensive Plan. <br /> <br />Motion carriedI Voting Yes: Mayor Gamec, Councilmembers Kurak, Cook, Elvig, Pearson, <br />Strommen, andiZimmerman.
