CouncihnembCr Kurak stated she understands all of the positions. The one thing she is <br />concerned about is that this fence is to hold the property owner's horse on his property. In the <br />current location of the fence if the horse puts its head over the fence it will be on someone else's <br />property and the property owner will be liable. She feels the two feet is a safety valve for the <br />property owner. <br /> <br />Councilmemb~ Cook stated the property owner knows his horses and must think they will not <br />go near the fence. Once the animals have touched the fence they will not go near it again unless <br />they are coaxed over. <br /> <br />Councilmcmber Elvig called for the vote. <br /> <br />Motion failed.: Voting yes: Councilmembers Cook and Pearson. <br />Councihnembers Elvig, Kurak, Strommen, and Zimmerman. <br /> <br />Voting No: <br /> <br />Mayor Gamec, <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Elvig to adopt Resolution #04-02-044 <br />based on and adopt the 23 Findings of Fact #0662, the City Council of the City of Ramsey herein <br />declares to modify the ruling of the Zoning Administrator, which has the effect of permitting the <br />electric wire strand fence as an acceptable fence material provided that the fence is placed a <br />minimum distance of two feet from the property line by July 1, 2004, and that the fence be <br />designed and constructed with a minimum of two (2) non-live wire strands affixed to the outside <br />of the fence posts and a maximum of two (2) live wire strands affixed to the inside of the fence <br />posts, as the decision relating to a request for appeal of the Zoning Administrator's interpretation <br />of Ramsey City Code relating to permitted fence materials in an R-1 Residential zoning district <br />on the property[owned by Bruce and Karen Konzack. <br /> <br />Motion carrie& VOting yes: Mayor Gamec, Councilmembers Elvig, Kurak, Strommen, and <br />Zimmerman. Voting No: Councilmembers Cook and Pearson. <br /> <br />Mayor Gamee informed the property owner the timetable for completion of the fence removal is <br />July 1 ~t. <br /> <br />Mi-. Konzack requested an extension due to the amount of trees. <br /> <br />Mayor Gamec i~ndicated he does not feel an extension should be given at this time. There needs <br />to be some performance and if there is a problem Mr. Konzack can discuss it with staff. The <br />whole intent is to have the job completed by July 1st. <br /> <br />Mr. Konzack asked if there are any issues or ordinances as far as taking down the trees. <br /> <br />Mayor Gamee informed Mr. Konzack to discuss this with the Zoning Administrator. <br /> <br />City Council/February 10, 2004 <br /> Page 15 of 18 <br /> <br /> <br />
