Pines subdivision. When Whispering Pines was developed in the early 1970's, drainage casements we 'e not taken, and an area of approximately 20 acres within this subdivision drains into the lot0~ nedib¥ Mr. and Mrs. Busl~'om located at 8341 - 154th Lane N.W. As a result, water ponds in th~ ] luslxom's back yard and an area immediately north of their property in the North Forty 3rd Ad~ ilion subdivision. The Bustrom's have a f'mished walk-out basement and they have reported wa~! s~a~ding as close as ten feet of theix home in the past. Mr. Jankowski explained that although th~ .~cv~l,oper of North Forty 3rd Addition is not responsible for providing drainage storage for ~ Wl~lspering Pines subdivision, the approved drainage and grading plan called for the conslxuc~i~n o4 a 100 x 230 foot drainage retention pond enlarging the natural low area behind the Bustron~'Siproperty. The dimensions of this proposed pond would provide several times thc pre-develoP'mi~nt ponding volume. He stated the developer did not address the complete pond as proposed to ~ gra~,~ ed and although he has until June, 1991 to take care of Phase I, which includes grading, lvlr: J~hakbwski feels it is exlremely important to have the grading completed immediately. His reasons )~ as~follows: 1) The grading done to date has likely caused a net decrease in the ponding volu~e available to store storm run-off; 2) The developer had graded other ponding areas in the ~ubdivision and had an opportunity to construct this particular ponding area according to plans; 3) 'I~e dgveloper was notified in writing that the existing grading was not acceptable and was given a reasonable amount of time (two weeks) to correct the grading; 4) That failure to grade the ponds this!fall.will present a substantial risk of flooding of the Bustroms walk-out basement during the cri~cal melt period next spring; and 5) That to allow the developer additional time this fall to correct ~he situation is no longer practical since impending frost conditions will make the grading more ~expcnsive or impossible. Mr. 3ankowski requested authorization to draw on the North Forty 3~ Addition Escrow Account and hire Dresel Construction to complete the grading if it has not be~ri done by the end of this week. He has already spoken to Drese] Construction and they will be a~e to do it upon request. Morion by C~n¢ilmember Cich and seconded by Councilmember Peterson to authorize Steve Jankowski to Contact Dresel Construction to do the grading immediately if it has not been taken care of bY the ~nd of this weclc The project will be funded with the escrow account monies. Motion carried. Voting Yes: Councilmember Cich, Peterson, DeLuca and Pearson. Voting No: None. Case #5: Receive Bids for River's Bend Park Handicapped Rails and Access Gate Improvement Project g90-29 Mx. Jankowsk~j stated that bid ads River's Bend Park Handicapped Rails and Access Gate Improvement ~'roj~ct g90-29 were placed in the Anoka Union and Construction Bulletin and also sent directly tc~ all tocal metal workers listed in the area yellow pages to try to obtain local bids. Two bids war~ received. The bid from DNCON, Inc. was for $25,577.50 and the low b~d (even lower than th~ Engineer's estimate) was from Selby Ornamental Iron Co. at $11,387.50. Mr. Jankowstd stat~ that Mr. Otto expressed his confidence in Selby Ornamental as he is familiar with their work. Motion by GoUneilmember Peterson and seconded by Councilmember Cich accepting bids for River's Bend~rk Handrails and Access Gate and awarding a contract to Selby Ornamental Iron Co. for such in~ProVements contingent upon CDBG approval.
