CONSENTI AGI:;iNDA Motion by Co~nciimember Pearson and seconded by Councilmember Peterson to approve the following item~ coatmned in the Consent Agenda: 1) Appr0Ue license applications. 2) Adopt resolhtion approving accounts payable transactions for the period October 15, 1990 through October 31, 1990 in the amount of $321,946.85. 3) Receivg report of cash flows for period ending October 31, 1990. 4) ReceiV~ La~dfill Tipping Fee and Expendable Trust Funds report. 5) Approge request for a one year extension from October 31, 1990 to October 31, 1991 to compiele sil~e improvements at Mad Mac's Auto Sales, 6750 Riverdale Drive N.W. 6) Adopt ~esolution approving payment to Vincent G. Hicks and Michelle M. Hicks for damag{s regulting from the extension of 153rd Avenue N.W. 7) Receiv~ letter from Anoka County Commissioner Natalie Haas Steffen regarding the dispoS~ of $1ag in the City of Ramsey and late night dumping at the landfill. 8) Appro~ change order no. 1 to Improvement Project #89-15. 9) Adopt ~sol~ution approving pay estimate no. 3 (final) to Aero Asphalt, Inc. in the amount of $5,447.14 for Improvement Projects ~90-10 and #90-12. 10) Adopt r~soti~tion approving pay estimate no. 6 (final) to Annandale Contracting, Inc. in the amounriof $_5,8"9 15.85 for Improvement Projects #87-'~7 and #89- I4 COUNCIL BUSINESS ;i Case #1: Yard Waste Compost Facility CUP - Reconsider Term Mr. Merland ;Otto, Hakanson Anderson stated that on October 23, 1990, the Ramsey City Council approved a c0gdm~bnal use permit for a yard waste compost facility for Waste Management of Minnesota. T~e te[rm of the permit was set for 20 months with a performance review set for September, 19~1. ;.Waste Management's legal counsel expressed concern with whether or not a new CUP coUl~ beiissued at the end of the 20 month term since Ordinance #90-5 would seem to prohibit that.: ~.he current CUP application was submitted prior to the adoption of Ordinance g90-5 and thereforei ~as riot subject to this ordinance. Otto recalled that it was City Council's desire to have firm ¢Oiqtrol regarding the term of the operation, however, it was not necessarily the intent of the Council ~to p~'eclude the applicant from obtaining a new CUP if the operation performed satisfactorily.; Wast~e Management of Minnesota is requesting Council to reconsider the term of the approved C:UP~r ah exemption to Ordinance #90-5 for the purpose of avoiding a situation where the operation:~ould be prohibited beyond the initial 20 months. Mr. Otto reviewed the possible options for res~vin!g this matter and stated that Staff is recommending the modification of the CUP to exempt the!piermit Holder from specific sections of Ordinance g90-5 for a period of 54 months Ed Morsefelder, Atlorney for Waste Management of Minnesota was present. He reviewed what went on at the:imeeting of October 23, 1990 and stated that Ordinance g90-5 was passed after Waste Manaaeh'~eni applied for a CUP. Waste Management asked for a period of 4-1/2 years and on that basis'~ ~ublic hearin~ was held.
