T~e te[rm of the permit was set for 20 months with a performance review set for <br />September, 19~1. ;.Waste Management's legal counsel expressed concern with whether or not a <br />new CUP coUl~ beiissued at the end of the 20 month term since Ordinance #90-5 would seem to <br />prohibit that.: ~.he current CUP application was submitted prior to the adoption of Ordinance g90-5 <br />and thereforei ~as riot subject to this ordinance. Ix. ff. Otto recalled that it was City Council's desire <br />to have firm ¢Oiqtrol regarding the term of the operation, however, it was not necessarily the intent <br />of the Council ~to p~'eclude the applicant from obtaining a new CUP if the operation performed <br />satisfactorily.; Wast~e Management of Minnesota is requesting Council to reconsider the term of the <br />approved C:UP~r ah exemption to Ordinance #90-5 for the purpose of avoiding a situation where <br />the operation:~ould be prohibited beyond the initial 20 months. Mr. Otto reviewed the possible <br />options for res~vin!g this matter and stated that Staff is recommending the modification of the CUP <br />to exempt the!piermit Holder from specific sections of Ordinance g90-5 for a period of 54 months <br /> <br />Ed Morsefelder, Atlorney for Waste Management of Minnesota was present. He reviewed what <br />went on at the:imeeting of October 23, 1990 and stated that Ordinance g90-5 was passed after <br />Waste Manaaeh'~eni applied for a CUP. Waste Management asked for a period of 4-1/2 years and <br />on that basis'~ ~ublic hearin~ was held.
