He also stated that the <br />language in tiii present CUP states no dismantling of engines and transmissions. That process is <br />handled at the ~Rog~.rs location. <br /> <br />Councilmemb~ Ci~h inquired if the excessive smoke report in 1989 and the five incident reports <br />and the one co~plamt this year were for the same thing. <br />Mr. Otto state~ it ~vas with regard to open burning. He explained that Mr. Karst put in heat <br />sensors and r/e~ bags in the furnace. Since December 5, 1989 there were only two incidents until <br />three weeks ag& Then there were three more incident reports within three days. <br /> <br />Councilmemb~r P~terson expressed his concern regarding the mention of disassembling being <br />done on Lots', ~ an~ 3. The incident referred to was of an employee cutting up feedstock next to <br />fuel tanks,em, ~e ~sked if that procedure is continuing. <br />Mr. Karst st_atari t~at the new CUP states that disassembly is permitted within an opaquely <br />screened area~ wil~hin the building. <br /> [ <br />Mr. Goodrich, City iAttorney commented that City Council should review items #29 through 37 of <br />the Planning ~d ~q~ning Findings of Fact as the language does not pertain very well to the issues <br />discussed and that t~hey should be reviewed and a decision made on each item individually. Mr. <br />Goodrich pr0c.~edetl to read these items and the following changes were made. Item #29 reads <br />"That the pr0p~se~ use w,!ll..." and it is changed to read "That the proposed use may .... <br />Consensus w~ithM Items 30 and 31 read okay. Item #32 is being deleted. Item #33 reads That <br />the proposed;u~e w. ill not be a substantial improvement.., and it will be changed to "That the <br />proposed use ~ill be an improvement . . ." Item #35 reads okay. Item #37 reads "That the <br />proposed use,'~ ill it~volve uses, activities, processes, materials and equipment and conditions of <br />operation tha, t rill be detrimental to any persons, property or the general welfare by reason of <br />excessive proCl~ ictio~ of traffic, noise, smoke, fumes, glare or odors" and it will be changed to read <br />"That the pr0t: >sed, use will involve uses, activities, processes, materials and equipment and <br />conditions of [o ~era~on that may be detrimental to any persons, property or the general welfare by <br />reason of profit Ctiot~ of smoke, fumes or odors. Item #37 reads okay as is. <br /> <br />Motion by Cou~cilmember Pearson and seconded by Councilmember Peterson to adopt Findings <br />of Fact #0284i(as lamented) relating to Danny's Aluminum Processing, Inc.'s request for'-a <br />conditional uSe~perm/t to expand an aluminum recover)., and processing business. <br /> <br />Motion carried~ V0tinz Yes: Mayor Reimann, Councilmembers Pearson, Peterson.
