Case #6: ~on~ider Introduction of Ordinances Extending Preliminary Plat, <br /> Fina~l Plat and Site Plan Agreement Time Limitations <br /> <br />City Attorney, l]lill Goodrich stated he had been directed by City Council to prepare two ordinances <br />for the purpoSe~f egtending the preliminary plat and final plat and site plan development contract <br />time limitati0~. ~e had prepared such ordinances. The Subdivision Ordinance extends the <br />preliminapa' pla~t to ~inal plat filing period to one year from date of approval and extends the final <br />plat filing pedo~t fora period of two years from the date of final plat approval. This is generally in <br />conformance ;w~th the State Statutes on this subject. The ordinance concerning site plans requires <br />the applicant !~ sigfl~ the development contract within 120 days of Council approval. There is no <br />State Statute g~erding this requirement, however, during discussion on October 23, 19~90,. it was <br />determined tllai thi~ would be an appropriate period of time for the developer to accomplish this <br />task. ~i <br />Motion by C%gcilmember Cich and seconded by Councilmember DeLuca to introduce Ordinance <br />#90-XX whic~ is lan ordinance amending Sections 170.0310A and 170.0310C of the City <br />Subdivision (2o~e reflating to the time periods for filing of preliminary plats and final plats. <br /> <br />Motion carried! Voting Yes: Mayor Reimann, Councilmembers Cich, DeLuca, Pearson and <br />Peterson. Votifig No: None. <br /> <br />Motion by C~u~cilmember Pearson and seconded by Councilmember Cich to introduce Ordinance <br />#90-XX which !s ad ordinance requiring that site plan development contracts be signed within 120 <br />days of site/deign gpproval and to direct City Attorney to amend proposed ordinance to provide <br />for extensions for the execution of site plan development permits. <br /> <br />Motion carricd~. Vbting Yes: Mayor Reimann, Councilmembers Cich, Pearson, DeLuca and <br />Peterson. voti~ N~: None. <br />Case #8: Charter Commission Appointments <br />City Administrator, ~avid Hartley stated that of the members of the Charter Comn'fission, five have <br />terms that exl~ii~ed 6n Ma3' 11, 1989. The remaining four have terms expirin~o on May 11, 1991. <br />He stated th~r~ had been an advertisement for applicants placed in th,e Ra~msey Resident last, <br />September, bUtS, ho applications were received. He explained that state law states a person can <br />serve two terms!. ' <br /> <br />Upon inquiu,, Mr. Goodrich answered that he wasn't sure if it meant just two terms or if it meant <br />two consecutive terms. <br /> <br />Councilmembe~ <br /> <br />DeLuca asked what would happen if no one wants to serve on the Commission. <br /> <br /> City Council/November 13, 1990 <br /> Page 11 of 16 <br /> <br /> <br />
