Mr. Goodrich asked City Council if everyone <br />had a chance!!~ .re~ and review the Attorney General~s Report, the City of Phoenix Report, the <br />Indianapolis Stt~dy~[the City of Rochester Study, the report prepared by the planner hired for this <br />project, and [fi,bver~Yone was present on May 29, October 10th, and April 24th. All answered <br />positive that they hd.d read and reviewed each report and/or study and also that the>, had attended all <br />meetings exce~ C0uncilmember Cich missed the meeting on October 10th. Mr. Goodrich stated <br />adult uses ar¢,.~rot¢cted constitutionally, however, because of secondary impacts, zoning is the <br />only way the:~Sty ~as of regulating these uses. The secondary impacts include increased crime, <br />deterioration O~property and bad influence on our children. <br />Councilmem~ D~Luca stated it is the concern of the Council to provide for the health, safety and <br />welfare of its:cOmmunity. It does have an impact because of an increase in sexual crimes and child <br />abduction anti be f~els that the Council is working along the right lines to provide for Ramsey's <br />residents. <br /> <br />Mayor Reimarin cOmmented that the Attorney General's report did a good job of incorporating <br />stuciies from Other i. · <br /> Oltles. <br /> <br />Councilmemb~r cich stated that his feelings regarding adult use establishments is that it leads to <br />the degradatiOri! of municipalities. <br /> <br />Attorney Good~nchi proceeded to read and review the Conclusions. Conclusions #1 through #3 <br />remain unchanjged, i Conclusion #4 was read and it was noted that churches had been omitted. <br /> <br />Zoning Administrator Frolik stated that it was her understanding that churches should be protected <br />as far as what is allBwed to operate next to them, however, churches are free to locate where ever <br />they want to oelfeel: the need to. <br /> <br />It was decid .¢d~ithatJ Conclusion #4 should read "Adult uses should be located in areas of the City <br />which are not !n cl'ose proximity to parks, schools, child care facilities, churches and residential <br />neighborhoodS. <br /> <br />Conclusion #$ contained a typo, the word "not" was inadvertently omitted. It should read <br />"Regardless ,o~ whi~ther or not ... It was agreed that Conclusions #6 and #7 remain unchanged. <br />Conclusions ~fl ahd #9 remain the same except when it reads entertainment uses it should be <br />changed to adult u$es. Conclusion #10 should be changed to include the word churches and also <br />insert adult UsC fo~entertainment use. There was discussion regarding the measurement of 1,000 <br />feet as opposelt, to ,750' Attorney Goodrich stated it was presented to Planning and Zoning as 750' <br />and the), suggasted; 1,000'. Discussion also took place regarding the percentage of total area a City <br />has to allow for adult use estabhshments. Conclusmn #11 should read Based upon the reports of <br />other cities, t~e A.G.'s Report, the September 20th Planning Report prepared by Northwest <br />Associated Co~nsul[tants, Inc., and this City's two public hearings ...."Conclusion #12 should be <br />added and reacts a~ follows: "It is not the'intent of this Council to further reeulate the location of <br />churches or C '4h)L?ch[related orgamzauons . <br />Motion bv GoCncilmember Cich and seconded by Councilmember Peterson to adopt the Proposed <br />Findings }as a~en~ted) regarding the Adult Use Study. <br /> <br />Motion carde~.
