CASE # I <br /> <br />REQUEST EORt A CONDITIONAL USE PERMIT TO HAVE HORSES ON LESS <br />THAN THREE (3) ACRES; CASE OF JAMES PAULZINE <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background:: <br /> <br />Unaware of City Code requirements regarding the maintenance of horses, James Paulzine brought <br />2 horses onto his pjroperty at 16350 Alpaca Street N.W. City Code states that a conditional use <br />permit is requiied i~n order to maintain up to 2 horses on parcels ranging from 1.5 to 3.0 acres in <br />size. The situ~{tion iwas brought to my attention and I forwarded a letter to Mr. Paulzine notifying <br />him that a conditional use permit is required in order to maintain horses on less than 3 acres. As a <br />result of my l~tter, Mr. Paulzine has applied for a conditional use permit for the horses. Mr. <br />Paulzine's property is approximately 2.04 acres in size and is located in the R-1 Rural Residential <br />Zone. <br /> <br />Observations: <br /> <br />Section 5.09,Q~ of:the Ramsey City Code states that no stable or barn that houses horses may be <br />located within150 feet of a place of human habitation and within 75 feet of property lines. Mr. <br />Paulzine's horses~are stabled in a temporary run-in shed that does not meet the 75 foot <br />requirement~ Mr. Paulzine has indicated that if the conditional use permit is approved, he will be <br />constructing a permanent structure for the animals that will meet all City Code requirements. <br /> <br />Mr. Paulzine has provided for 1.5 acres of fenced roaming area for the 2 horses. The roaming area <br />exceeds 1/2 a'~ere Per horse and in accordance with City Code, Mr. Paulzine is not required to <br />submit a pl~.,for manure storage and weekly disposal thereof. The fence is constructed of 3-rail <br />l"x8" red oak with 4"x4" pine fence posts. <br /> <br />The Horse Care Commission met on Tuesday, February 18 and recommended approval of Mr. <br />Paulzine's request contingent upon the following: a) a minimum 500 square foot permanent <br />structure to h~usethe horses being in place by December 31, 1992; b) the temporary structure <br />being removed by!December 31, 1992; c) a favorable response to the request from neighbors; d) <br />proper maintenance of the fence; e) no exterior storage of hay.
