CASE # 2 <br /> <br />REQUEST FOR SKETCH PLAN REVIEW; <br />CASE OF GERALD BAUER <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background:; <br /> <br />Gerald Bauer i$ requesting sketch plan review to plat property located east of St. Francis Blvd. and <br />Gobernatz Addition at 177th Avenue N.W. The proposed subdivision consists of reconfiguring <br />3 existing lotS[ totgling approximately 48.5 acres. The individual lot sizes resulting from the <br />reconfiguratiofi would be 2.5 acres, 9.7 acres and 35.1 acres. The site location map, proposed <br />subdivision and CitY Engineer's review letter dated 2/27/91 are enclosed for your information. <br /> <br />Observations: <br /> <br />The proposed subdivision would comply with the 4 in 40 density requirements because there is <br />and will contirlue to be 3 lots in 48 acres. However, the minimum lot size in the Rural Service <br />Area is 10 acre~. I believe in this particular case, the City could vary from the 10 acre minimum lot <br />size because there is not a creation of new lots but rather a realignment of existing lot boundaries. <br /> <br />Mr. Bauer is i'equesting that the subdivision be considered a minor subdivision. A minor <br />subdivision is defined as a plat containing 3 lots or less that requires no public improvements. Mr. <br />Bauer is propo~sing not to extend and improve 177th Avenue so that all of the lots will have 200 <br />feet of frontage on a public road. Mr. Bauer has stated that Lot 3 exists today as a landlocked <br />parcel and he ~e has no desire to remedy that situation because he has no immediate plans to <br />develop Lot: 3:~ I understand that Mr. Bauer feels there is no urgency to correct an existing <br />substandard p~cel that he has no itmnediate plans for. But by virtue of his application to replat the <br />property, he h~s initiated a new subdivision that should be platted according to design standards <br />established in City iCode. Some of the design standards include that: a) Provisions shall be made <br />for the continaation of existing and future streets; b) All lots shall have at least the minimum <br />required frontage on a publicly dedicated street. <br /> <br />The sketch plan is being presented to the Park and Recreation Commission on March 7 for <br />determination Of park dedication. <br /> <br />Recommendation: <br /> <br />The procedures to be followed from this point will depend on whether or not the Commission <br />determines that a subdivision or a minor subdivision is appropriate in this case. If the Commission <br />determines that a minor subdivision with no improvements is appropriate, then upon a favorable <br />sketch plan review Mr. Bauer can proceed to City Council for final plat approval. If it is <br />determined tha/[ a full subdivision meeting all of code requirements (street prof'fles, drainage plans, <br />building setback lines, etc.) is appropriate, then Mr. Bauer would proceed to preliminary plat <br />stage. <br /> <br />CommissiOn Action: <br /> <br />Will be based on your discussion. <br /> <br />Review Checklist: <br /> <br />Zoning Administrator <br />City Engineer <br /> <br />P&Z: 3/5/91 <br /> <br /> <br />
