REVIEW

BUSINESS AND INDUSTRIAL ZONING
By: Zoning Administrator Frolik

CASE #3:
DISTRICTS

Background:

At the February 5, 1991 meeting of the Planning and Zoning Commission, it was noted that the
newly amended zoning districts contained an error. During the 1990 zoning amendment
discussions, the Planning and Zoning Commission recommended that exterior storage as an
accessory use to a principal permitted use should be a allowed and exterior storage as a principal
use of property, should require a conditional use permit. This recommendation was aimed at the I-1
Industrial, Rural Industrial and Business Warehouse Districts.

Observations:

The zoning amendments adopted by City Council state that exterior storage as an accessory use in
the Business Warehouse District is permitted provided it does not exceed 10% of the property and
exterior storage as a principal use of property requires a conditional use permit. In the I-1
Industrial Disffict,: exterior storage as an accessory use is permitted and exterior storage as a
principal use requires a conditional use permit. In the Rural Industrial District, exterior storage as a
principal or a~essory use of property requires a conditional use permit.

In reviewing the B' 1 and B-2 Districts, I interpret the zoning ordinance to state that exterior storage
(principal or ~cessory) is neither a permitted use nor a conditional use. In the B-3 Business
District, exterior storage as a principal use is permitted with a conditional use permit but exterior
storage as an aCcesSory use is neither a permitted nor a conditional use.

A copy of all 'of the Business and Industrial District zoning regulations are enclosed for your
review.

Recommendation:

Review all BuSiness and Industrial District zoning regulations to determine if they meet the intent
of the Planning and Zoning Commission's past recommendations. If not, then the Planning and
Zoning Commission should initiate an ordinance amendment.

Commission Action:

Will be based on your discussion.

NOTE: YOU WERE PROVIDED A COPY OF THE BUSINESS AND
INDUSTRIAL ZONING DISTRICT REGUATIONS IN YOUR FEBRUARY 28,
1991 WORKSHOP AGENDA

Review Checklist: Zoning Administrator
P&Z/EDC: 2/28/91
