Mr. Gordon noted that the Chaska ordinance would open it up to anyone. <br /> <br />Commissioner Watson stated that he would be uncomfortable with that. <br /> <br />Mr. Gordon inquired if the Committee was comfortable with keeping accessory apartments as <br />item I on their permitted use or take it out until they are ready to adopt performance standards. <br /> <br />Consensus was to omit accessory apartments with the intention of brining it back. <br /> <br />Councilmember Kurak stated that any new development should require a screening fence along <br />any major thoroughfare and barbed wire fences should be restricted based on lot size. <br /> <br />Councilmember Hendriksen stated that if the theory is restrictions are based on lot size, then they <br />have to let them be entitled to what is permitted. He stated that there is something wrong with <br />drawing a hypothetical line and changing what can or cannot be permitted on a parcel. <br /> <br />Commissioner Watson inquired if a home on five acres burned down could they rebuild as it <br />was. <br /> <br />Mr. Gordon replied yes. <br /> <br />Councilmember Anderson stated that currently they allow a four-foot fence in the front and eight <br />foot in the back so why are they changing. <br /> <br />Mr. Gordon replied that based on the discussion from last meeting, it seemed that there needed to <br />be a difference between urban and rural areas. <br /> <br />Councilmember Hendriksen inquired if someone owned a property for 50 years and the MUSA <br />expands to include their property, have their restrictions have changed? <br /> <br />Councilmember Kurak replied that the property owner could continue the use, but if they change <br />something, then they have to comply with the new regulations. <br /> <br />Commissioner Reeves stated that it was time to move on. <br /> <br />Councilmember Hendriksen stated that someone can lose their grandfathering by ceasing <br />activities for six month. <br /> <br />A heated discussion occurred regarding the issue of grandfathering. <br /> <br />Councilmember Hendriksen left the meeting. <br /> <br />Mr. Gordon reviewed the proposed changes regarding sod. <br /> <br /> Chapter 9/April 25, 2002 <br /> Page 7 of 9 <br /> <br /> <br />
