Councilmember Riley introduced the following resolution and moved for its adoption: RESOLUTION #14 -10 -224 RESOLUTION GRANTING A UTILITY EASEMENT OVER A PORTION OF CITY - OWNED PROPERTY WHEREAS, Connexus Energy has approached the City of Ramsey seeking an utility easement over the southern ten (10) feet of the property located at 7443 Highway 10 NW; and WHEREAS, the purpose of the utility easement is to allow for the installation if a ground electrical transformer to service the westerly adjacent parcel at 7575 Highway 10 NW; and WHEREAS, the City of Ramsey acquired 7443 Highway 10 NW through the Right -of- Way Acquisition Loan Fund (RALF) program in 2008; and WHEREAS, the executed Loan Agreement for the acquisition of 7443 Highway 10 NW prohibits the conveyance or encumbrance of any RALF property without the consent of the Metropolitan Council. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA: 1) That the Ramsey City Council hereby grants a ten (10) foot utility easement over, under and across a portion of 7443 Highway 10 NW as described in Exhibit A, attached hereto. 2) That the Ramsey City Council hereby authorizes the Mayor and City Administrator to execute an easement to Connexus Energy for utility purposes. 3) That the Ramsey City Council hereby authorizes the Mayor and City Administrator to execute an Amended Agreement and Restrictive Covenant relating to the RALF property. The motion for adoption of the foregoing resolution was duly seconded by Councilmember LeTourneau, and upon vote being taken thereon, the following voted in favor thereof: Councilmember Riley Councilmember LeTourneau Councilmember Backous Councilmember Johns Councilmember Kuzma Councilmember Tossey and the following voted against the same: None
