- 2 -

order to accomodate the Airport and its required restricted
zones, a ¢omp~ehensive plan amendment will most likely be
required as ~1l zoning ordinance amendments. Therefore, the
interim ordinance imposing a moratorium as described in MSA
462.355 subd. 4 above, would be appropriate evem though the
airport property and other affected property is currently
privately own'ed., Please note that the moratorium is two and one-
half (2 1/2) years.

One note of caution is that a moratorium such as being
comtemplated will affect property owners' rights to develop
and/or sell ~hetr property. Therefore, depending on the exact
interim ordiNanCe adopted, 'the City could become liable to
damages if alproperty owner is denied the right to develop and/
or sell his Property. This then means that the City should be
reasonably certain that it intends to proceed with the Airport
project prior' to adoption of the above referred to interim
(moratorium) ordinance.

The interim ordinance can provide for moratorium restrictions
similar to those which are anticipated to be included in the
final Airport Zoning Ordinance.

For your information, I am attaching a proposed £nterim
ordinance. In order to pass thta ordinance, the City's Planning
Commission m~st conduct a public hearing after ten (10) days'
published no~ice. Upon receipt of the Planning Commission's
finalizing a~d recommendation, the Council can act on the
ordinance. If the Council votes by a four-fifths (4/5) majority
to adopt the ordinance, it becomes effective thirty (30) days
-after its first publication, unless during said thirty (30) day
period a citizen's petition is received by the Council asking for
a referendum on the subject.
