CHAPTER ~ <br />NOMINATIONS AND ELECTIO~IS <br /> <br /> Section 4.01; ~ThelRegular Municipal Election. A regular municipal election <br />shall be held on [he ~lrst Tuesday after the first l'~onday in November of each even <br />numbered year co~r%ne~ng in 1984 at such places as the ,~'<' council shall desig- <br />nate. At least fit~teen days prior not?e- · r ll be given by the clerk-administrator <br />by posting_ a not~e thereof in at leas~ one public place in each election precinct, <br />and by publ±shing';a notice thereof at least once in the official newspaper of the <br />city stating the' ~ime and the places of holding such election and of the officers <br />to be elected. Fa~.lut4e to give such notice shall not invalidate such election. <br /> <br />Elected and qualified officers provided for by this charter shall assume the duties <br />of office to which they were elected on the first business day in January following <br /> <br />such election. <br /> <br /> Section 4.0~.~!Fiiing for Office. No earlier than fifty-six days nor later <br /> <br />than twenty-eightl days before any municipal election, any resident and registered <br />voter of the cit~ qualified under state statutes for elective office may, by filing <br />an affidavit andi!by paying a filing fee to the clerk-administrator in an amount as <br />set by ordinance; ha~e his/her name placed on the municipal election ballot. <br /> <br /> 4.02i01.i Any applicant currently holding an elected office in the <br /> <br />city, and seeki~n~ ellection to an office different from the office he/she currently <br />holds and subject to the limitations prescribed in Section 2.04., shall be required <br />to submit his/he? resignation from his/her current office upon filing his/her <br />affidavit. The a~fi~avit, resignation and fees shall be submitted to the clerk- <br />administrator no'earlier than fifty-six days nor later than forty-two days before <br />any municipal ~l!ection.
