CHAPTER 1 0 <br />FRANCHISES <br /> <br /> Section 10.0t~ ExCept as otherwise provided by state statutes, no person, form <br />or corporation m~ll ~lace or maintain any permanent or semi-permanent fixtures <br />in, over, upon or'under any street or public place for the purpose of operatin~ a <br />public utility, ;ol f~r~ any other purpose, without a franchise therefor from the <br />city. A franchiSe[sh~ll be granted only by ordinance, which shall not be an <br />emergency ordinan,~e, iNo exclusive franchise shall be granted unless the proposed <br />ordinance is submitted to the voters of the city following a public hearing and <br />approved by at [east[a majority of those voting thereon. Every ordinance granting <br /> <br /> shall~co~tain all the terms and conditions of the franchise. The <br /> franchise <br />a <br /> <br />grantee shall b~ t~e costs of publication of the franchise ordinance and shall <br />make a suffieie~ide~osit~ w~th the clerk-administrator to guarantee publication <br />before the ord~ce~is passed. <br /> <br /> Section 10.0~. T~rm. No perpetual franchise or priviledge shall be created, <br />nor shall any eX~lus ye franchise or priviledge be granted for a period of more <br /> <br />than twenty-f lye .,years. <br /> <br /> Section 10.~~. P~blic Hearing. Before any franchise ordinance is adopted or <br /> <br /> ~ ori prices to be charged by a public utility are fixed by the <br />any rates, fare~ <br /> <br />council, the eou~cili shall hold a public hearing on the matter. Notice of such <br />hearing shall Bei!puhlished at least once in the city newsletter and in the <br />official newspaper ~ot less than ten days prior to the date of the hearing. <br />Failure to publish ~aid notice or any defect in said not±ce shall not ~nvalidate <br />the notice.
