WMMI has <br />the following comments on the proposed ordinance identified <br />above. <br /> <br /> As you know, the Anoka landfill falls within the area <br />affected DY the proposed Gateway North Industrial Airport Zoning <br />Ordinance ("Zoning Ordinance"). As you are also aware, WMMI has <br />been pursuing a vertical expansion of the existing landfill site <br />since 19815. Permit applications for the expansion were filed <br />with the Metropolitan Council, the MPCA and Anoka County in <br />August 1985~ WMMI has obtained a certificate of need for a <br />vertical expansion of the landfill from the Metropolitan Council <br />based upon an application dated April, 1986. The environmental <br />review process for the expansion is currently well under way with <br />the Met~o~oliitan Council acting as the responsible governmental <br />unit in C~mp~eting the E.I.S The existing and continuing use of <br />the cur-r~ntl landfill site~ including the expansion, is an <br />existingl !no~-conforming use. Accordingly, the language of the <br />proposed Ord~nance, and in particular Section VII thereof, should <br />be modified! to remove any inconsistent limitation on the <br />definition of non-conforming use. <br /> <br />EXHIBil' / <br /> <br /> <br />
