Accordingly, currently, state oil <br />and gas mining laws do not trump town zoning laws enacted to prohibit <br />fracking. <br />Source: Law 360; www.law360.com <br />PENNSYLVANIA <br />Reportedly, Penn Township is "considering a change to its zoning laws that <br />would further restrict Marcellus Shale gas drilling in residential and com- <br />mercial areas." As part of the township's comprehensive revision of zoning <br />laws, the proposed changes "would create a special zoning district with <br />setback requirements between drilling operations and homes, schools and <br />businesses on properties encompassing less than a prescribed acreage." "The <br />overlay district, which superimposes additional regulations onto existing zon- <br />ing laws, would not apply to rural areas and those zoned for agricultural and <br />industrial use."
