December 10, 2014 1 Volume 8 1 Issue 23 Zoning Bulletin <br />Zoning News from Around the <br />Nation <br />MICHIGAN <br />Legislation proposed in the state Senate—Senate Bills 1123 and <br />1124—aims to restrict "nuisance" lawsuits filed over wind turbines. <br />The bills would exempt from lawsuits those who operate or own wind <br />turbines that are in compliance with state and local rules. The bills <br />would prohibit lawsuits such as those filed by 17 Mason County <br />residents against Consumers Energy over negative health impacts, <br />including dizziness, sleeplessness, headaches and other physical <br />symptoms they allege are being caused by wind turbines. Bill propo- <br />nents think the proposed legislation will "put more of an onus on our lo- <br />cal zoning officials to really dig in and make sure their ordinances <br />protect health and safety." <br />Source: Michigan Capital Confidential; www. michigancapitolconfid <br />ential.com <br />MINNESOTA <br />In early November, the Minnesota Supreme Court heard objections <br />to a city of Winona law that limits the number of rental homes on each <br />city block to 30% of all homes. Opponents argue that the city "does not <br />have the authority to limit the number of homeowners who can rent <br />their properties," and that the law is unconstitutional. <br />Source: MPRNews; www.mprnews.org <br />OREGON <br />The Albany City Council has adopted locational restrictions for sell- <br />ers of recreational marijuana and marijuana -infused products. They <br />reportedly mirror restrictions on medical marijuana dispensaries. The <br />restrictions are effective immediately.
