All information provided by the <br />Qty and the OMC S*udy Group is included i n the Rndings feport Appendix (click here #1 #2 #3 #4-14 #155). <br />M EEIfl NG NOTES <br />OMC3udy Group members were able to utilize M PCA noise decibel reading equipment at the meeting; <br />and, a second opportunity to utilize M PCA equipment was provided at a subsequent meeting. A data <br />center employee volunteered to come to this meeting and answer noise related questions. Lastly, a City <br />Gaff member, experienced with land use regulations and code enforcement was also available at this <br />meeting to provide insight and answer C 4C3udyGroup questions, related to land use regulations. <br />A number of questions were asked at this meeting. Follow up answers were provided via email, and are <br />i ncl uded in the Rndings /port Appendix (click here to view). <br />Astrong process for regulation and enforcement of Qty ordinances exists today. If the Sabject Property <br />was developed as a data center, the Qty would lean back on existing code enforcement processes to <br />correct potential noise violations. <br />With that in mind, in order to provide an extra layer protection and further address noise concerns <br />raised by residents, City staff would propose making data centers a "Conditional Use" in City zoning <br />ordinances --rather than simply making a data center a "Permitted Use." In this scenario, a data center <br />user would be required to apply for, and attain, a "Conditional Use Permit" (CUP) from the City in order <br />to operate. <br />Granting a CUP provides two extra layers of protection to residents <br />A Allows the Qty to add reasonable land use conditions specific to the property to prevent <br />potential negative impacts on surrounding property owners before a development <br />moves forward (site plan review process). <br />B. Provides the Qty with strong/clear legal case to require a property owner violating Qty <br />zoning ordinances to come back into compliance. Why? Qty may revoke (terminate) <br />CUP --if City imposed 'conditions' outlined in said CUP are violated. <br />The following restrict ions would be proposed: <br />A. Backup generators may not be run during the night, any day of the week, 6:00 p.m. to <br />8:00 a.m., unless for emergency purposes only. <br />B. Backup generators may not be run during the weekend, 83turday and S nday, anytime, <br />unless for emergency purposes only. <br />C Inquired use of sound attenuation enclosures for generators. <br />Lastly, it should be noted, additional sound mitigation techniques are included in the building design and <br />site layout section of this document. <br />CMCStudy Coup, Findings Deport (DPAF7) Page 15 of 42 <br />
