Regardless of future land use on the LMA, the provisions within the Dedaration of Restrictions and <br />Covenants recorded against the property prohibit the construction of structures without prior written <br />approval of the M PON and the installation of drinking water wells without prior written approval of the <br />M PCA and Minnesota Department of Health (M DH). <br />Affected Property off the LMA <br />Minn. aat. § 1156.412, 9abd. 4(b) requires local units of government to incorporate information about <br />the landfill and associated groundwater contamination and landfill gas migration into any land -use plans <br />and to notify persons applying for a permit to develop affected property of the existence of this <br />information and, on request, to provide them with the information. <br />Certain land -use controls pertinent to groundwater use and well construction within the GWAOC <br />currently exist to protect public health and safety. Rrst, M inn. Rules Chapter 4725.4450, subp. 1 <br />requiresthat awater supply well cannot be constructed within 300 feet of the Landfill. 5?cond, the <br />M DH has authority to approve the construction of drinking water wells. Therefore, the information <br />pertaining to the GWAOChas been provided to M DH to assist them with their authority for approving <br />the construction of potential new wells near the Landfill. <br />The M GAOCis contained within the LMA. Therefore, no additional land -use controls are necessary to <br />prohibit the construction of buildings close to the landfill's waste. <br />DI9CLAI M 6 <br />The MPCA makes no representations or warrant ies to the user of the accuracy, currency, suitability, or <br />reliability of the data presented in this report. Any recommendations made by the M PCA in this report <br />are based solely on the data it has, or its contractors have, collected, and only from data collected at <br />specific locations and times. Other sources of contamination or methane, unknown to the MPCA, could <br />exist off the Landfill property. The MPCArecommendsthat any person interested in developing <br />property near the Landfill first consult with an environmental consulting or engineering firm, and/or an <br />environmental attorney, regarding the possible risks associated with the Landfill. <br />6 <br />
