Motion by Cor~missioner Bauerkemper and seconded by Commissioner Sieber to amend SeCtion 7.04.01 by adding the following as the final sentence: 'The annual f~nanc~al statement shall be in such form as State statutes, this Charter or'CitY Council shall determine.' Motion carrieR. Voting Yes: Chairman Heitman, Commissioners Bauerkemper, Data, Sigher, IGamec and Greenberg. Voting No: None. Absent: Commissioners Buchanan, Lic~ter and Titterud. The CommisSio~ proceeded to review Accountant Moens concerns with Section 7.11, confusion Created in referring to Tax Anticipation Certificates and Certificates of Indebtedness. Commissio~co~sensus is to change the title of Section 7.11 to 'Tax Anticipation Certifiaates' ~and in the second line of the section replace reference to 'Certificatesiof Indebtedness' with 'Tax Anticipation Certificates'. The Commission proceeded to review Accountant Moen's concerns with Section 7.07.02,~a~y ~bligation incurred without authorization being the personal obligation oflthe person incurring the obligation. Mr. Schnelle inquired as to what would happen in an emergency situation that ended up bein~ a major cost item. Commissioner Sieber replied that Section 7.07.01 addresses situations where it is untimel~ to gain Council approval prior to spending. The purpose of the first sentence in Section 7.07.02 is to make sure no one spends any money tha~ CoUncil has not told them they can spend; the loophole is there. If they dQ their job with a certain amount of pride and recognize a necessary expense, theylcan go to City Administrator for direction. Mr. Darryl Fults inquired what would happen if a police squad car was in need of immediate repair. Mr. Schn~lle replied that the Charter will allow for the expenditure but it will make an'employee reluctant to do so without first checking with the Mayor or City-Administrator. Commission consensus is to amend Section 7.07.01 as follows: On page 7-5/5, first lin~, delete.th~ last word 'shall' and replace with 'and certain other city offioials as designated by Council are' The commission recessed at 9:45 p.m. Commissioner Greenberg dismissed himself from the meeting at this time.
