I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />! <br />I <br />I <br />I <br /> <br />Mayor Ga~ec s~ated that the City current ordinance regarding unlicensed <br />vehiclesi&llo~s~ · r for one unlicensed vehicle on the property~ suggested that <br />the protective covenants and homeowners association agreement allow for <br />no unlicensed~vehicles. <br /> <br />Mr. CarsOn stated there would be no problem including that restriction; <br />that he thought the current ordinance did not allow for any unlicensed <br />vehicles. <br /> <br />Mr. Schnelle stated that no parking should be allowed in the common driveway <br />area. <br /> <br />Mr. Carson stated that the Homeowner's Association Agreement and P~strictive <br />Covenants wi~1 apply to cluster housing and Restrictive Covenants only, will <br />apply to SiRgle family dwellings. <br /> <br />Mayor Ga~ec ii~equested that the developer make sure that the City's animal <br />ordinanael and the restriction to no unlicensed vehicles be included in <br />both the ~o~eowner's Association agreement and the Restrive Covenants. <br /> <br />Mr. Goc~rich'stated that Council should feel free to add or delete or amend <br />the progosed'findings of fact. <br /> <br />Mr. Raatikka!noted a correction to the proposed findings of fact: Items 8 <br />and 9 should~be corrected to specify 2.3 acres of proposed commercial <br />property. <br /> <br />Mr. Goodrich requested that Council pay particular attention to Item #10 of <br />the pro, sed~ findings of fact. <br /> <br />Councilmembe~ Schlueter recalled that at one time Planning and Zoning discussed <br />the building setback and inquired if a minimum setback is specified in the <br />plan. <br /> <br />Council Consensus is that there should be a setback minimum of 20', which is <br />what is shown on the plan. If the plan is approved, then the developer is <br />locked into that 20' minimum. <br /> <br />Council~em~.r Schlueter expanded on her past comments regarding Item #11 of <br />the fin~ing~ of fact regarding the plan creating an excessive burden. In <br />her opin~on~the project will involve more time and labor on the part of City <br />Staff, and not necessarily in excess and not necessarily in terms of cost. <br /> <br />Motion by CQuncilmember Sorteberg and seconded by Mayor Gamec to approve the <br />findings or'fact for Flintwood Hills Second Addition, a P.U.D. <br /> <br />Motion. carried. Voting Yes: Mayor Gamec, Councitmembers Sorteberg and <br />Schlueter.~ Voting No: None. Absent: Councilmembers Reimann and Van Wagner. <br /> <br />Motion by C°uncilmember Sorteberg and seconded by Mayor Gamec to approve the <br />propose4 r6strictive covenants, which will include that no unlicensed vehicles <br />will be allowed,' for Flintwood Hills Second Addition, a P.U.D. <br /> <br />Motion Carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg and <br />Schlueter~ Voting No: None.
