Council's duty is to consider the application <br />for P~r~tjr keeping in mind standards for consideration and <br />criteriail flor approval and performance standards set forth in the <br /> use Management provided all <br />condi tiOnal~ <br /> ordinance. <br /> Waste <br /> has <br />information! necessary to show that those standards are met; <br />Council'~ ~uty is not discretionary; if criter'ia are met the <br />permit i ~usit be granted. Waste Management respectfully requests <br />that Cou~ci~l grant the application. <br /> <br />Mr. Oresen - 6530 153rd Lane - Stated he l~ves to the north of <br />the lan~fi!ll and the dumping is on the opposite side of the hill <br />from his !home and does not feel a berm will reduce the noise <br />problem .'i ' <br /> <br />Mayor !G~mec introduced Charles LeFevere, attorney working with <br />Ramsey oh ~he Landfill lawsuit. <br /> <br />Mr. Lel~ege tie stated that Council should prepare a separate <br />findingsi of fact from that which was adopted by Planning and <br />Zoning. <br /> <br />Mayor G~mec stated that his intent is to vote no to Waste <br />Manage~eRts; request be. ced on recent legislation and what he has <br />been ?.r~mi!sed by legislators if they are elected in the way of <br />financia~ ~ewards to cities with landfill problems. <br />Motion ~y i C0mmissioner Schlueter to adopt Findings of Fact as <br />presen~e~ iby Planning and Zoning regarding Waste Management's <br />request for~ a Conditional Use Permit. <br /> <br />Councilm,ember Van Wagner seconded the motion for. discussion. <br /> <br />Further ~i~ Diiscussion: .~ Councilmember Van Wagner stated that she <br />would il~ke~ to review the Findings of Fact f. irst.
