.I <br />'1 <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br /> ! <br /> ! <br /> ! <br /> <br />RESOLUTION #82- <br /> <br /> ! iWHE~EAS, the City proposes to improve a portion of 167th Avenue <br /> County State Aid Highway #5; and <br /> located betWeen[State Aid Highway #47 and <br /> ,~HE~EAS, the improvement consists of widening the shoulders, <br />new blackt0~ii mat and reconstructing said roadway including necessary storm <br />water drain~.ge facilities where necessary in order to provide for the <br />safety of ~he traveling public; and <br /> <br /> [ E~EAS, in addition to the existing highway easement, certain <br />lands in fe~[ ar~ required for said improvement together with (1) temporary <br />highway eaSe~en,~s which expire on or before July 1, 1983, and (2) permanent <br />drainage andi utility easements; and <br /> <br /> ~FNHEREAS, the lands required are more particularly described as <br />parcels 1 -!26 .~f project #82-1 as prepared by the City Engineer. <br /> <br />NOW THEREFORE, ~E IT RESOLVED, that the City Council hereby authorizes the <br />City Attorh~Y t+ proceed to acquire the fee simple, permanent easements, and <br />temporary hi~hW%y easements over said lands in accordance with Minnesota <br />Statutes. ~ <br /> <br />BE IT FURTM~,R RgSOLVED, that these lands as described above which cannot <br />be acquire~_ ~y ~irect negotiation, shall be acquired by eminent domain and <br />the City h~r~.byirequests the City Attorney to file the necessary petition <br />therefore,la%d ~o prosecute such action to a successful conclusion or until <br />it is abando~ed~ dismissed or terminated by the City or Court. <br /> <br /> <br />
