I I I I I I I I I Re: Terry Hendriks~n Drainage Problem Dear Council Members: As requested at.you~ October 26, 1982 council meeting, I have reviewed the facts concerning the above referenc'edproblem. At your October 26,: 1982 meeting, I stated that at the time of my last communication with the Anoka. County Highway Department, they were still waiting for either an acceptance or rejection by Mr. Hendriksen to their October 4, 1982 offer. Mr. Hendriksen stated that he and his attorney had rejected that offer and that the County was dragging:their feet since they had not attempted further settlement of the problem. I reviewed thisiproblem with Mr. Bud Redepenning of the Anoka County Highway Depart- ment on October 27,!1982, and he again stated that Mr. Hendriksen had not rejected their last offer. Therefore, Mr. Redepenning was given direction by the County Attorney's offiqe not to do any work to correct the drainage problem. The County Attorney's office assumed that Mr. Hendriksen was seriously considering their last offer since they wege taking so much time. In review of the statement by Mr. Hendriksen stating that the drainage prablem and the condemnation were two separate issues and the County wanted to solve them together, I foumd this to be incorrect. Mr. Redepenning told me they would be willing to solve the issues~separately but either Mr. Hendriksen or his attorney wanted them solved together. I have informed Mr.:Hendriksen of my findings and told him he or his attorney should contact the County in regard to their last offer. I also recommended to him that he request that the' drainage problem be solved separately and immediately to alleviate any flooding next spring. civil · municipal · planning a soils · land surveying
