CASE #: 4 <br />INTRODUCE ~[)RDINANCE TO AMEND CHAPTER 9 OF THE RAMSEY CITY <br />CODE, ~;EC?I()NS 9.02, 9.21.23, 9.50.37, 9.50.50, AND SECTION 9.50.57 <br />By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />In recent w~eks, ~..ity Staff and the Planning and Zoning Commission have reviewed the need to <br />amend various parts of the Zoning and Subdivision Chapter. <br /> <br />The first area !o ~ amended is Section 9.02 (Definitions). The purpose of this language change is <br />to etiminate;tl~e op~portunity to include road right-of-way when determining minimum lot area and <br />to include a:di~finition for parcel. The past practice has been to allow developers to include road <br />right-of-way Wher~ determining whether or not the plat meets the minimum lot area, i.e., number of <br />acres divid~d'iiby ;~.5 acres inclusive of road right-of-way. For code enforcement purposes, the <br />practice has beenj to determine lot size based on distances from property line to property line. <br />Consequently, porsons that thought they bought into a 2.5 acre subdivision very often have <br />something le~s than 2.5 acres and do not qualify for a metal accessory structure. The elimination <br />of languageiatlow!ng for the inclusion of road right-of-way in minimum lot area should bring some <br />continuity tO development and subsequent code enforcement. <br />The second area is amendments to Sections 9.50.37, 9.50.50 and 9.50.57 relative to subdivision <br />design stan~i~ds, i:Basically, it is requiring developers to not only dedicate land for parks and trails <br />to satisfy park replication requirements, but also to install the improvements. The City Engineer <br />will place a:~toll~ value on the improvements installed and that amount will also be credited <br />towards th~ Park dedication due on the plat. The amendment also allows the City to set the park <br />dedication f~ anfiually by resolution versus by ordinance amendments. <br /> <br />The third area is modifying the B-3 Highway Business District to broaden the permitted uses to <br />~nclude retml' acti¥~ty and professional offices. In addition, the code currently lists certain uses that <br />could be dev*lop~d in this district with a conditional use permit if they met certain cfiter/a. In an <br />effort to el;iminate the frequency by which conditional use permits are required, we have also <br />modified thi, s s~tion to include those conditional uses as permitted uses and changed the <br />conditional Use permit criteria to general performance standards in the section. We did eliminate <br />the ability toi,hav~ exterior storage as a principal use of property on Hwy. #10 and we limited the <br />amount of e~teridr storage that would be allowed as an accessory use of property. <br />Staff was ttlSo directed to research the possibility of including language in the B-3 Highway <br />Business Di~trici regulations to amortize all nonconforming uses into compliance, relative to <br />required si~e~impyovements, within a specified time frame. Language has been drafted to require <br />all sites in.t§e B{3 District to be in compliance with the required site improvements (paved and <br />curbed driveway, s, customer/employee parking and outside display/sales areas) by January 1, <br />1997. Please ref~er to 9.21.23, subd. 4, item #22. Language has also been included to establish a <br />procedure f~ apl~lying for extensions to this compliance date. <br /> <br />A copy of proposed Ordinance #92-~ is enclosed. <br /> <br /> <br />
