NOW, 'TH£REFORE, the CITY and DEVELOPER agree as follows: <br /> <br />STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES <br /> - <br /> i. City Code Comrdiance. That the DEVELOPERS will develop the Plat in <br /> -accbrdance with the City Code, Section 9.50, entitled "Subdivision" and Section <br /> ~ 9.20.31 entitled "Planned Unit Development". <br /> <br /> i Cohformance with Plan. The Plat. shall be developed pursuant to the final <br /> pla{ consisting of two (2) sheets and dated received by the CITY on October 23, <br /> 1992. <br /> <br /> Intmr~oralion of All City Code Requirements. That the recitals above and <br /> the', provisions of the City Charter, Subdivision Code, Zoning Code and Public <br /> ImProvement Code of the CITY as amended to date hereof, are incorporated herein <br /> by itel. fence. <br /> ? <br /> <br /> Staee ][ Irrmrovements Required. The DEVELOPER agrees to construct the <br /> r~fiired Stage I improvements according to the terms and conditions of this <br /> contract and in accordance with DEVELOPERS' plans submitted to the CITY. <br /> Sa!d plans shall be in general conformance with the plans prepared by Probe <br /> Efl~gineering and dated received by the CITY on April 20, 1990, and consisting of <br /> $~eets 1 through 12 of 12. <br /> <br />It is hereby agreed that the name of the proposed streets in the Plat may deviate <br />frCm the City's grid pattern and be named St. Andrews Lane, St. Andrews Circle <br />~ Inverness Circle. It is also agreed that the right-of-way for said streets shall be <br />at :the standard sixty-six (66) feet but that the improved width shall be approved at <br />29 feet. <br /> <br />BOulevard an6 Area Restoration. The DEVELOPER shall be responsible <br />ethe cost of establishing seed or sod in all boulevards within thirty (30) days of <br />completion of the street improvements, and restore all other areas disturbed by <br />t~e development ~ading operation in accordance with the approved erosion and <br />s&timent control plan. The DEVELOPER shall also be responsible for the cost of <br />cIeaning any soil, earth or debris from the wetlands within and adjacent to this Plat <br />r~.sulting from grading performed in the development of the land. <br /> <br />l~eouirements after Street SurfaCing. After the street surfacing is installed, <br />tl~e DEVELOPER shall clear any soil, earth, or debris from the streets and from <br />tl~e lots within the Plat resulting from any construction on the Subject Property by <br />the DEVELOPER or their successors and assigns. <br /> <br />Sta~oe I lmt~rovements - Comt>letion Date. The Improvement completion <br />ffat~ shall be-on or before August ]5, 1993. <br /> <br />S1a~e I _Improvement Financial Guarantee. The DEVELOPER a~ees <br />~d understands that the CITY has the right, privilege and authority pursuant to <br />Minnesota Statutes Chapter 462.358 and as amended as a condition precedent to the <br />approval of the plans and specifications and approval of a final plat, to prescribe <br />~equirements and the extent to which, and the manner in which the streets are to be <br /> <br /> <br />
