CASE <br /> <br /> ADOPT ELECTRIC FRANCHISE ORDINANCE <br /> By: Ryan R. Schroeder, City Administrator <br /> <br />Background~ <br /> <br />As Coun~cil w~ll recall, m September 1992 the issue of the appropriateness of a possible <br />franchi~ 'trdi~ance and subsequent fee for that franchise with Anoka Electric Cooperative, <br />the An0l~ M~icipal Electric Company and Midwest Gas was raised. At the meeting in <br />Septemt ; at ~,hich this was discussed, Mr. Rick Newland of Anoka Electric Cooperative <br />requesr~ Ihat!the Council consider adoption of an electric franchise ordinance. Enclosed <br />for yoU~ r ~viegv is the ordinance which I believe the Anoka Electric Co-op is requesting <br />your co6s der~tion. Staff drafted this ordinance based upon the model ordinance prepared <br />by the SUburb~m Rate Authority. We supplied draft copies to all three utilities (although it <br />was pertinent to only two of them) for review and comment. It was reviewed by the City <br />Attorne~ land lwe have integrated ail comments that we have received to date. This <br />ordinan~e~spe~ifically defines the relationship between the utility and the municipality and <br />defin, e$ i-right~, and obligations of each party as it relates to delivery of the electric <br />dismbU~i6n, fftilization of right-of-ways and utilization of infrastructure by either party. <br />Copies:~f~his !atest draft have been supplied once again to all three utilities. <br /> <br />It is my iu~der~tanding that the Anoka Municipal Electric Company and the Anoka Electric <br />Coopera~ve ~aj, e in agreement with the terms of the ordinance granting the franchise which <br />is stated i0 the~ordinance for a 20 year term. <br />This ordinanC~ was introduced at the November 10, 1992 City.
