I I i I ! CASE INTRODUCTION OF AN ELECTRIC FRANCHISE ORDINANCE By: Ryan R. Schroeder, Cily Administrator Background: As Council will recall, in September 1992 the issue of the appropriateness of a possible franchise :~cc and subsequent fee for that franchise with Anoka Electric Cooperative, the AnO_~) M.U~icipal Electric Company and Midwest Gas was raised. At the meeting in Septera~, at ~hich this was discussed, Mr. Rick Newland of Anoka Electric Cooperative requcsr~ Mt ~e Council consider adoption of an electric franchise ordinance. Enclosed for yoUr, r~vicW is the ordinance which I believe the Anoka Electric Co-op is requesting your corts~e~tion. Staff drafted this ordinance based upon the model ordinance prepared by the SUburban Rate Authority. We supplied draft copies to all three utilities (although it was perdficnt io only two of them) for review and comment. It was reviewed by the CiE, Attorney and lwe have integrated all comments that we have received to date. This ordinan0elsp¢~ifically defines the relationship between the utility and the municipality and defines rightS: and obligations of each party as it relates to delivery of the electric distribution, u~ilization of right-of-ways and utilization o£ infrastructure by either party. Copies of this latest draft have been supplied once again to all three utilities. It is my underga~, ding that the Anoka Municipal Electric Company and the Anoka Electric CooperatiVe arg in agreement with the terms o£ the ordinance granting the franchise which is stated iri thc brdinance for a 20 year term. Recommendation: It is my reeom~, endation that Council introduce this ordinance. Council Action: Motion to inu'oduce the ordinance ~m-anting Anoka Electric Cooperative and Anoka MunicipalElectric Company a franchise for electric distribution systems.
