..A~NDMENT TO CITY C~ARTER iBY Will,am K. Gooarich, City Attorney Backgroun~ At its Aug~sti27, 1992 meeting the Charter Commission recommended an Amendment ~o Chapter 8 of the city Charter. This chapter is titled "Pm~li~ Improvements and Special Assessments". The proposed amendmen~ Ss~n attempt to be~ter organize the City's procedures and policies to a~sessment The special projects. proposal would re~ir% that all city special assessment pro~ects be conduc=e~UTSuant to Chapter 429 of the State Statutes. This is a signific~n~ improvemen= for =ne City's bond issue~ as it will enable bOn~ c~unmel to is=ue more positive opinions as =o the legal procedureS~used in the City's special assessment projects. This may tran~ia~in =ne ~uture %o bet=er bond ratings. The amen~me~ doe~ maintain the 60 day waiting period and pe=itionin~ p~ooezs which gives residents =he ability to stop a ~roj~t ~h,y ~is~pprove. . No city re~er~nd~ on a charter amendment is necessary where the amendment~ is ~ecommanded by the Charter Co~ission and pas~ed by the City C~n~Oil as an Ordinance. However, a public hearing on the proposed ~en~men~ is re~ired prior to ordinance passage.
