I I I I I I I ORDINANCE #92_- CITY OF RAMSEY ANOKA COUNTY STATE OF MINNESOTA AMENDM~I~T 'ro CHAPTER 8 OF THE HOME RULE CHARTER OF THE CITY OF RAMSE~ YVHICH CHAPTER 8 IS ENTITLED "PUBLIC IMPROVEMENTS AND sPECiAL ASSESSMENTS". The City of Ramsey Ordains: This Ordin~ce is enacted pursuant to Minnesota Statutes §410.12, Subd. 7. SECTION 2. REPEAL AND AMENDMENT. Sectio0s 8.!01 through Section 8.06 'of Chapter 8 of the Home Rule Charter of the City of R. amSey ~ hereby repealed and replaced with the following sections: Seqtion 8.01. power to Mak~ Improvements and Levy Assessm?nt~. The City may make any type of local improvement not forbidden by law and levy special assessments to pay all or part of the cost of such local improvements. The total of ' the iassessments for any local improvement may not exceed the cost of the local i improvement, plus all costs and expenses connected therewith, including interest. :: No!assessment shall exceed the benefit to the property assessed as measured by the i inci'ease in the market value of the property assessed as a result of the local i improvement. : Sedtion 8.02. Application of Charter. All local improvement projects shall be : "car~ed out exci~ively under the provisions of this Charter. The term "local im rovement" as used in this section shall a 1~ . mean public improvement financed - parity or wholly from special assessments. SeCtion 8.03. Assessments for Services. The Council may provide by ordinance · :that the cost of the City services to streets, sidewalks, or other public or private sP~?eerty may be assessed against property benefited and may be collected in the manner as special assessments. Se0tion 8.04. Local Improvement Procedure. When the City undertakes any local ~ ~ml~rovement to which the State local improvement code applies, it shall comply wi~ the provisions of that law, except as modified below. The Council may by 'ordinance prescribe the procedure to be followed in malting any other local : improvement and levying assessments therefor. SeCtion 8.04.01. ~ixtv D~v W~i~ing Period. A period of sixty (60) days shall elapse after the concltision 'of the public hearing required by law to precede the ordering of the construction of a local improvement project (the "Public Hearing") ! before the actual ordering of the local improvement by the Council and the Council entering into a contract for the local improvement construction.
