CASE <br /> <br />REQUE~rr FOR A CONDITIONAL USE PERMIT FOR AN OUTSIDE <br /> !DISPLAY/SALES AREA; CASE OF TOM KURAK <br /> By: Zoning Administrator SyLvia Frolik <br /> <br />Background: <br /> <br />Mr. Tom Kumk iS proposing to establish a motor vehicle sales lot at 7665 Hwy. gl0 N.W. The <br />subject property i~; approximately 2.2 acres in size and is zoned B-3 Highway Business. Motor <br />vehicle sales Is a Oermitted use in the B-3 Business District. However, a conditional use permit is <br />requiredif a perml~tted use in the B-3 District includes an outside display/sales area. Mr. Kurak is <br />proposing to hav~ 27 vehicles in the outside display area and has applied for a conditional use <br />permit accordingly. <br />The following iterfls are enclosed for your information: <br /> a) Sit~ location map <br /> b) Sitg plan and landscaping plan <br /> c) Me'mo from Building Official Glyn Huff dated 9/14/92 <br /> c) ' Prdposed findings of fact <br /> d) : Prc~posed conditional use permit <br /> <br />ObservatiOns: <br /> <br />The Planning ~and Zoning Commission conducted a public hearing on the proposal and there were <br />no written or 9erb~ comments submitted regarding the proposal. <br /> <br />In accordance witl~ the setback regulations established for the B-3 Highway Business District, Mr. <br />Kurak has pr°Vide, j:l for a 17 foot setback of the display area from the front property line. <br /> <br />Also in accordane~with City Code, Mr. Kurak is proposing to provide 2 employee and 3 customer <br />parking spae.0s. 'The applicant is proposing to hardsurfaee the driveway, customer/employee <br />parking area 8nd 9ehicle display area with concrete. The City Engineer and the Planning and <br />Zoning Co~ssi~n have approved the installation of surmountable cement curbing versus the B- <br />612 type of ettrbin~[. <br /> <br />The landscaping isiproposed to consist of rock gardens on both sides of the entrance to the facility. <br /> <br />The existing house on the property would be used as office space. The existing barn on the <br />property woi~ld re,hain vacant. The Planning Commission expressed concern with the structural <br />soundness of the barn and whether it posed a danger to persons on the property. The Building <br />Official inspebtedithe barn on 9/14/92 and determined that the barn should not pose a threat to <br />persons on th~ pro?erty. <br />The proposed Conditional use permit includes requiring the applicant to deposit a financial surety <br />with the City t~ gu [~antee the installation of the proposed site improvements. <br /> <br />Recommendation: <br /> <br />City Staff andithe Planning and Zoning Commission recommend approval of the conditional use <br />permit. <br /> <br /> <br />
