o <br /> <br />o <br /> <br />10. <br /> <br />ll. <br /> <br />12. <br /> <br />The 0utd6or display area and customer/employee off-street parking spaces shall be <br />restricted tO those areas of the parcel that are hardsurfaced with either concrete or asphalt. <br /> : <br /> <br />The Permi!tee shall be responsible for installing the following required improvements: <br /> <br />a) Co~crete or asphalt driveway, customer parking, employee parking, and vehicle <br /> display area. <br /> <br />b) Concrete curbing the perimeter of the driveway, customer parking, employee <br /> par~ing, and vehicle display area. <br /> k <br /> <br />c) Lagdscap~ng in accordance with the plan dated received by the City on September <br /> I, !992. <br /> <br />In order to lensure the installation of the improvements described above, the Permittee shall <br />be required~ to deposit a financial guarantee with the City in the form of cash or letter of <br />credit,approved by the City as to form, in the amount of Eleven Thousand Seven Hundred <br />Seven,fy Five Dollars ($11,775.00), whmh ~s 150% of the City's estimated cost of the <br />~mprovements. <br /> <br />Upo~n completion of the construction of the improvements, as certified by the City <br />Engit~r, Ope financial guarantee shall be released and any credit balance remaining in the <br />cond½t{onalr use permit escrow account shall be returned to the Permittee. In the event the <br />Permi~ee ~'ails to construct and install the improvementes as required herein, and the <br />concllti~nal} use permit has not been voided for lack of initiation within the required twelve <br />(12) mOnth[time frame, the City may complete the improvements with City day labor and/or <br />by let~ng~ c~ntracts for said completion and draw upon the financial guarantee for payment. <br />Permittee lJereby grants permission and a license to the City and/or its contractors and <br />assisgr~s t~ enter upon the site for the purpose of completing the construction and <br />installation [of the Improvements in the event of Permittee's default. <br /> <br />The ouJtsid~ storage of any inoperable and/or unlicensed vehicles, or parts thereof, on the <br />subject.~pro~eny is prohibited. <br /> <br />All lightin~ on the subject property shall be arranged so as to deflect away from adjacent <br />siTe,.ts.: <br /> <br />The Permittee agrees to connect to City sewer and water at the time sewer and water is <br />extended t(~ the area and herein agrees to join in a petition for such improvements when <br />such p~titio~ns are presented. However, the Permittee does not relinquish their fights under <br />M/nne~°ta Statutes Chapter 429, or Ramsey City Code Chapter 4, to appeal the amount of <br />the assessments. <br /> <br />The City A{:lministrator, or his designee, shall have the right to inspect the premises for <br />compliance [and safety purposes annually or at any time, upon reasonable request. <br /> <br />The Permitt4~e shall be responsible for all City costs incurred in administering and enforcing <br />this condifidnal use pemait. <br /> <br />13. <br /> <br />14. <br /> <br /> <br />
