City Charter Apendix A I I I I I I I I I I I benefitted property owners proposed to be assessed for such improvement at least equ~l to the m~mber of those who petitioned for the improvement, the council shall not make such improvement at the expense of the property benefitted, unless, in the meantime, there be filed with the council a petition asking that the improvement be made,, signed by benefitted property owners proposed to be assessed for such improvement at least equal in number to those who signed the petition against the improvement; in such event the council may disregard the petition against the improvement. Any person whose name appears on a petition to the council for a local improvement, or on a petition to the council against a local improvement, may withdraw his/her name by a statement in writing filed with the council-before such petition is presented to the council or in person at a public hearing. 8.5~2 l~egardless of the provisions in section 8.5.1, when less than 80 percent of tl~e estimated cost to the city of a proposed local improvement is to be paid for by special assessment, excluding minor ordinary expenses incurred in the course of City a[ffairs'within the sixty day period after a public hearing has been held on the proposed improvement, a petition may be filed with the council, signed by a number of~ voters greater than 50% of the number of registered voters at the time of the last city wide election, protesting against either the improvement, or the financing method, or both. In this event, the council shall not proceed with the improvement as proposed. 8.5.3 The city council shall follow the uniform contracting law for advertising end :.receiving bids. In the event the lowest responsible bid exceeds the cost estimate as provided for in section 8.5.1 by more than 10%, then no contract shall be let, ex/d in order to implement the proposed improvement, it shall be necessary toi institute the proceedings for such improvements DE NOVO. 8.5.4 When a proposed improvement is disallowed under the foregoing .sections, the council shall not vote on the same improvement within a period of one year after the public hearing on said improvement. Section 8,6 Assessments for Services. The council may provide by ordinance that the cost of city services to streets, sidewalks, or other public or private property may be assessed ag~nst property benefitted and may be collected in the same manner as special assessments. Such costs shall not be deemed to be "special assessments" for~ the purposes set forth in section 8.3 of this chapter. Printed 12/28/90 Page 19
