That the DEVELOPERS,, will develop the Plat in <br /> a¢~rdance with the City Code, Section 9.50, entitled Subdivision" and Section <br /> 9.20.31 entitled "Planned Unit Development". <br /> <br /> COnformance with Plan, The Plat. shall be developed pursuant to the final <br /> pl~t consisting of one (1) sheet and dated received by the CITY on August 31, <br /> 1992. <br /> <br /> ln6orDoratlon of All City Code Requirements. That the recitals above and <br /> th~pr~visions of the City-Charter, Subdivision Code, Zoning Code and Public <br /> Improvement Code of the CITY as amended to date hereof, are incorporated herein <br /> by reference. <br /> <br />Staue I IIl~nrovements Rermired. The DEVELOPER agrees to construct the <br />reqgtred Stage I Improvements according to t e terms and conditions of th~s <br />eo~tract and in accordance with DEVELOPERS' plans submitted to the CITY. <br />Sai~l plans shall be in general conformance with the plans prepared by Probe <br />:Engineering Company, Inc. and dated received by the CITY on April 20, 1990, <br />, and consisting of Sheets 1 through 12 of 12. <br /> <br />It ia hereby agreed that the name of the proposed street in the Plat may deviate from <br />~ the iCity's grid pattern and be named St. Andrews Lane. It is also agreed that the <br />rigl~t-of-way for said street shall be at the standard sixty-six (66) feet but that the <br />: pavement applied to St. Andrews Lane shall be approved at a width of 29 feet. <br /> <br />Bmilevard and Area Restoration. The DEVELOPER shall be responsible <br />for lthe cost of establishing seed or sod in all boulevards within thirty (30) days of <br />:the bompletion of the street improvements, and restore all other areas disturbed by <br />the ilevelopment grading operation in accordance with the approved erosion and <br />~sedi~.ent control plan. The DEVELOPER shall also be responsible for the cost of <br />iclea~, ing any soil, earth or debris from the wetlands within and adjacent to this Plat <br />resulting from grading performed in the development of the land. <br /> <br /> Requirements after Street Surfacine. After the street surfacing is installed, <br /> ithe DEVELOPER shall clear any soil,-earth, or debris from the streets and from <br /> .the lots within the Plat resulting from any construction on the Subject Property by <br /> ~the DEVELOPER or their successors and assigns. <br /> <br /> Stage. 1 Improvements - Completion Date. The Improvement completion <br /> date!shall be on or before December 31, 1992. <br /> Sta~e ! Improvement Financial Guarantee. The DEVELOPER agrees <br /> and [mderstands that the CITY has the right, privilege and authority pursuant to <br /> Minhesota Statutes Chapter 462.358 and as amended as a condition precedent to the <br /> <br /> <br />
