NOW, T['IEREFORE, the CITY and DEVELOPER agree as follows: STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES Ci~v Cod~ Compliance. That the DEVELOPERS,, will develop the Plat in a¢~rdance with the City Code, Section 9.50, entitled Subdivision" and Section 9.20.31 entitled "Planned Unit Development". COnformance with Plan, The Plat. shall be developed pursuant to the final pl~t consisting of one (1) sheet and dated received by the CITY on August 31, 1992. ln6orDoratlon of All City Code Requirements. That the recitals above and th~pr~visions of the City-Charter, Subdivision Code, Zoning Code and Public Improvement Code of the CITY as amended to date hereof, are incorporated herein by reference. Staue I IIl~nrovements Rermired. The DEVELOPER agrees to construct the reqgtred Stage I Improvements according to t e terms and conditions of th~s eo~tract and in accordance with DEVELOPERS' plans submitted to the CITY. Sai~l plans shall be in general conformance with the plans prepared by Probe :Engineering Company, Inc. and dated received by the CITY on April 20, 1990, , and consisting of Sheets 1 through 12 of 12. It ia hereby agreed that the name of the proposed street in the Plat may deviate from ~ the iCity's grid pattern and be named St. Andrews Lane. It is also agreed that the rigl~t-of-way for said street shall be at the standard sixty-six (66) feet but that the : pavement applied to St. Andrews Lane shall be approved at a width of 29 feet. Bmilevard and Area Restoration. The DEVELOPER shall be responsible for lthe cost of establishing seed or sod in all boulevards within thirty (30) days of :the bompletion of the street improvements, and restore all other areas disturbed by the ilevelopment grading operation in accordance with the approved erosion and ~sedi~.ent control plan. The DEVELOPER shall also be responsible for the cost of iclea~, ing any soil, earth or debris from the wetlands within and adjacent to this Plat resulting from grading performed in the development of the land. Requirements after Street Surfacine. After the street surfacing is installed, ithe DEVELOPER shall clear any soil,-earth, or debris from the streets and from .the lots within the Plat resulting from any construction on the Subject Property by ~the DEVELOPER or their successors and assigns. Stage. 1 Improvements - Completion Date. The Improvement completion date!shall be on or before December 31, 1992. Sta~e ! Improvement Financial Guarantee. The DEVELOPER agrees and [mderstands that the CITY has the right, privilege and authority pursuant to Minhesota Statutes Chapter 462.358 and as amended as a condition precedent to the
