CASE #3 <br />CONSIDER RECOMMENDATION OF PLANNING AND ZONING COMMISSION <br />TO 1NirrI3~TE ACTION TO REVOKE CONDITIONAL USE PERMIT FOR <br />DANNY'S ALUMINUM PROCESSING, INC. <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />In 1990, th¢ Cityiof Ramsey issued an amended conditional use permit to Dan Karst (Danny's <br />Aluminum ProceSsing, Inc.) to increase his aluminum processing operations by the addition of a <br />second melt f~trna~e. At the time this conditional use permit amendment was under review, it was <br />noted that~ Mt. K~st was storing feedstock (buses) on his adjacent lots. As a result of this <br />discussion, one o~ the terms of the amended conditional use permit required Mr. Karst to either <br />remove ali buses for apply for a site plan review by the Spring of 1991 to provide an exterior <br />storage plan it~ aCCordance with City regulations. Accordingly, Mr. Karst did apply for a site plan <br />review t° add~'ess Mse of his adjacent lots for exterior storage purposes and a building expansion. <br />He also applied fbr a another conditional use permit amendment to allow him to disassemble <br />engines and tmns ~a~issions within the existing building on the site; thus the reason for the building <br />expansion. · ~ <br /> <br />The Planning and Zoning Commission reviewed the site plan and the request for a conditional use <br />permit amet~dment~ and recommended City Council approval of same. Following that, Mr. Karst <br />requested thatiI- table his case from Council action until he could re-evaluate market conditions and <br />th.e.i .mpact t°liis b~usiness as a result of a competitor establishing a similar facility in the immediate <br />v~cmlty. <br /> <br />For various reaso!~s, a year has passed and now Mr. Karst has revived his conditional use permit <br />amendment :a~d siye plan. However, he has made substantial changes to what the Commission <br />reviewed a y~ear ago. In addition to disassembling engines and transmissions within the building, <br />he is reques~ng th~ ability to act as a redemption center to receive other non-hazardous metals and <br />batteries for~cyc!ing purposes. As for the site plan, the expansion of the existing building has <br />been eliminated anti he is proposing to construct a 13,000 square foot building on his adjacent lots <br />to provide s~a~e for disassembly of engines and transmissions and space for acceptance of other <br />non-hazardous: ma[erials not related to the aluminum processing operation. Rather than resuming <br />his case wher~ it ~as in the process last year and forwarding Mr. Karst onto City Council for <br />action, I felt that ithe changes to the conditional use permit amendment and site plan were <br />substantial et~ough itc justify bringing Mr. Karst back to the Planning and Zoning Commission for <br />an addifional:pUbli~ hearing and further consideration. <br /> <br />In the interim, Commissioner Deemer of the Planning and Zoning Commission pointed out that <br />Mr. Karst apPears tO be in violation of his current conditional use permit and that more than one <br />year has passed sin~e P&Z acted on the request which was to be forwarded to Council. As a result <br />of this disctlsSion~at the August 4 Planning and Zoning meeting, a motion was passed to <br />recommend that Ci[y Council consider initiating action to revoke Mr. Karst's existing conditional <br />use permit. - <br /> <br />Recommendation: <br /> <br />As I mentioned earlier in my report, Mr. Karst has revived his site plan review and conditional use <br />permit amendment requests. Those applications were reviewed by the Planning and Zoning <br /> <br /> <br />
