My opinion is that the <br /> City has no Obligation to assist in this costs. <br /> <br /> In form~lating this opinion I have reviewed relevant sections <br /> of the City ¢~de, together with the City's Resolution #85-89, which <br /> resoluti~h ~s entitled "Resolution Establishing Construction, <br /> I . <br /> Financing, C~nnectlon and Assessment Policies on Streets and <br /> Utilities.~'' <br /> <br /> The ~on~rolling City Code Section is §9.50.50 "Construction <br /> Improvements,. Subdivision 1 of that section states in part <br /> ". . . th~ s~bdivider shall make provision in the manner herein- <br /> after set forth for the installation, at the sole expense of the <br /> subdividg~, ~f such improvements as shall be required by the City, <br /> · . . ".(emPhasis added). Subdivision 2 of §9.50.50 states that <br /> streets a~e a required improvement in any urban area subdivision. <br /> There is n~ P~ovision in §9.50.50 requiring the City to participate <br /> in the co~t Of MSA streets which are a required plat improvement. <br /> <br /> In ~evi~wing city Resolution #85-89, I note that under Section <br /> E, "Procedures Relating to Special Assessments", paragraph 11 <br /> referenoes M~A streets. I do not believe this paragraph is <br /> applicabl~, .~owever, in that this entire Section E provides for <br /> procedur$~ r~lating to special assessment projects and not new <br /> subdivisi0ns.i <br /> <br /> <br />
