WHERI~AS, City Code Section 9.50.50 defines "Stage I" Improvements and "Stage II" <br />ImprovementS w~ch defmifion is used herein when reference is made to "Stage I" and "Stage 11" <br />Improvements; an~ <br /> <br /> WHE.RE~S, the DEVELOPERS desire to construct the Stage I and Stage II <br />improvementS, except for those Stage II Improvements constructed by the CITY; and <br /> <br /> wHEREAs, the CITY has determined that contributing to the development of the <br /> l <br />Subject Property ~by subsidizing the construction of the Municipal State Aid road is necessary to <br />providing a ~om~onent of the frontage road prescribed in the Highway #10 Corridor Study <br />prepared by l~m4n.Aschman Associates, Inc., dated January 1988; completing a frontage road <br />that is an imPort~nt aspect of the Metropolitan Council regional development framework; and <br />providing access.t? a regional park. <br /> <br /> NoWi: THEREFORE, the CITY and DEVELOPERS agree as follows: <br /> <br /> I. <br /> I IMPROVEMENTS AND FINANCIAL GUARANTEES. <br /> <br />STAG ~E <br /> <br /> Code Comoliance. That the DEVELOPERS will develop the Plat in <br /> aed0rdanee with the City Code, Section 9.50, entitled "Subdivision" <br /> <br /> Cohformance with Plan. The Plat. shall be developed pursuant to the f'mal plat <br /> cOfi, sisfing of three (3) sheets, prepared by Hakanson Anderson Associates, Inc., <br /> entitled Rivenwick and printed on August 20, 1992. <br /> <br /> Ineor0oration of All City Code Reouirements. That the recitals above and <br /> the provisions of the City Charter, Subdivision Code, Zoning Code and Public <br /> ImI,r°vement Code of the CITY as amended to date hereof, are incorporated herein <br /> bY :'eference. The CITY agrees to continue its best efforts to amend the Municipal <br /> Ua,an Service Area boundary to include the entirety of the Subject Property. <br /> <br />Stsl~e I Imorovements Reauired. The DEVELOPERS agree to construct <br />the[3eCluired Stage I Improvements according to the terms and conditions of this <br />cor~tract and in accordance with the DEVELOPERS plans submitted to the <br />CITY. Said plans shall be in general conformance with the Grading Plan prepared <br />by David J. Nash and dated June 22, 1992. The final construction plan for sanitary <br />se,.4er, storm sewer, watermain, and street improvements shall be submitted to the <br />Ci~ Engineer for review and approval prior to construction. The City Engineer <br />shall have complete access and oversight authority over all phases of construction <br />i of !he project.
