Mr. Jim Gromberg
Mr. Don Greenberg
July 7, 1992
Page 2

excess of the six years set forth in the statute. Your lawyers
will find that this is a "very active" statute and that it has
been liberally construed.

Our clients have owned and used their property at 14100
Jasper and the Outlet B access since 1977. Their property is a
substantial and valuable piece of improved real estate.

They purchased the 14100 Jasper property (in 1977) from
Gateway North Industrial Park who granted them the Outlet B
access and is now attempting to "sell" and "rezone" all of
Outlet B, which they apparently still own.

The City has plowed, graded and "placed culvers on" part of
Outlet B so as to provide access to 14100 Jasper. They have
treated part of Outlet B as a public street for many years.

If this access over Outlet B is denied to 14100 Jasper,
Minnesota Sawdust will suffer serious and permanent damage.

I will be out of town Monday through Friday, July 6-10; but
I would like to hear your intentions during the week of July
13th. If I do not hear from you by July 15th, we will place
this matter in suit.

Sincerely,

GRAY, PLANT, MOOTY,
MOOTY & BENNETT, P.A.

C.
