I I I I I I I I I I I I I I I I I I I ToiControl the possibility of dust and debris escaping the facility during all filling, grading, stockpiling and crushing operations, the permittee will sweep the fol~0wing listed streets in the area of the proposed use weekly, or more frequently if ne~ssary, to remove any dust and debris that should escape the site: 143rd Avenue N~W. from Ramsey Blvd. N.W. to Jaspar Street N.W. and Jaspar Street N.W. to the:~site entrance. 18. ff site Op~tions cease, the Conditional Use Permit becomes null and void and all materials rela~ to [the production of aggregate on the site shall be removed by the operator within nine~ (90~ days of the date of termination of the Permit. The permittee shall provide a financial g~arantee at the City, in the amount of Eight Thousand Dollars ($8,000.00) to insu~re~.oval of all demolition rubble in the event the permittee fails to perform said rem0 ,~al upon the conditional use permit becoming void or revoked. The financial gu~i may be in the form of cash or an irrevocable Letter of Credit or some other form ~ fi~ r ~~accep.ta..ble to the City: This .fin .apcial guarantee shall be maintained at the City ~Ilong as the condmonal use perrmt rematns an full force and effect. 19. The ,oPera(Or of the facility will provide a visual inspection of all trucks and remove any debris., froM them prior to the trucks leaving the site, and take precautions to prevent spillage from tracks. 20. The City may initiate action to revoke the conditional use permit in accordance with procedures!established in the Ramsey City Code. 21. The failUreiof the City at any time to require performance by the permittee of any provisions hereOflshal! in no way effect the right of the City thereafter to enforce the same. Nor shall waixter bY ~e City of any breach of any of the provisions hereof be taken or held to be a waiv~ off,any succeeding breach of such provision or as a waiver of any provision itself. 22. If any Pro,.~sion of this CUP shall be declared void or unenforceable, the other provisions shall not b~ affected, but shall remain in full force and effect. r · 23. The Ci~ty Admimstrator, or his/her designee, shall have the right to inspect the premises for comp!!~n¢~ and safety purposes annually or at any time, upon reasonable request. 24. The permit'~ee shall be responsible for all City costs incurred in administering and enforcing this ¢oltdi~onal use permit. Said expenses shall be paid within fifteen (15) days of billing by the City[and failure to pay the City's expenses within the fifteen (15) day billing period will partnlt~ the City to drawn upon any of the escrows required by this agreement for pay~¢gt. The permittee shall maintain a $2,000.00 balance in an escrow account with the City.~ i'Thi~ escrow shall be used to reimburse the City for expenses incurred in the admi~ ~ tracon of this permit in the event the permittee fails to pay the City expenses within the.fifteen ~ay billing period. The City reserves the right to use these funds to pay for testmg~serv~ces as necessary.
