The permittee shall provide a <br /> financial g~arantee at the City, in the amount of Eight Thousand Dollars ($8,000.00) to <br /> insu~re~.oval of all demolition rubble in the event the permittee fails to perform said <br /> rem0 ,~al upon the conditional use permit becoming void or revoked. The financial <br /> gu~i may be in the form of cash or an irrevocable Letter of Credit or some other form <br /> ~ fi~ r ~~accep.ta..ble to the City: This .fin .apcial guarantee shall be maintained at <br /> the City ~Ilong as the condmonal use perrmt rematns an full force and effect. <br /> <br />19. The ,oPera(Or of the facility will provide a visual inspection of all trucks and remove any <br /> debris., froM them prior to the trucks leaving the site, and take precautions to prevent <br /> spillage from tracks. <br /> <br />20. The City may initiate action to revoke the conditional use permit in accordance with <br /> procedures!established in the Ramsey City Code. <br /> <br />21. The failUreiof the City at any time to require performance by the permittee of any provisions <br /> hereOflshal! in no way effect the right of the City thereafter to enforce the same. Nor shall <br /> waixter bY ~e City of any breach of any of the provisions hereof be taken or held to be a <br /> waiv~ off,any succeeding breach of such provision or as a waiver of any provision itself. <br /> <br />22. If any Pro,.~sion of this CUP shall be declared void or unenforceable, the other provisions <br /> shall not b~ affected, but shall remain in full force and effect. <br /> r · <br />23. The Ci~ty Admimstrator, or his/her designee, shall have the right to inspect the premises for <br /> comp!!~n¢~ and safety purposes annually or at any time, upon reasonable request. <br /> <br />24. The permit'~ee shall be responsible for all City costs incurred in administering and enforcing <br /> this ¢oltdi~onal use permit. Said expenses shall be paid within fifteen (15) days of billing <br /> by the City[and failure to pay the City's expenses within the fifteen (15) day billing period <br /> will partnlt~ the City to drawn upon any of the escrows required by this agreement for <br /> pay~¢gt. The permittee shall maintain a $2,000.00 balance in an escrow account with the <br /> City.~ i'Thi~ escrow shall be used to reimburse the City for expenses incurred in the <br /> admi~ ~ tracon of this permit in the event the permittee fails to pay the City expenses within <br /> the.fifteen ~ay billing period.
