I I I I I I I I I I I I I I I I I I I CASE REQUEST FOR METES AND BOUNDS SUBDIVISION; CASE OF WALTER SCROGGINS By: Zoning Administrator Sylvia Frolik Background: Mr. Walter,S~'oggins is requesting a metes and bounds subdivision to create a 5 acre homestead from his 4.91 ag~ re, parcel located at the southeast intersection of 153rd Avenue N.W. and Sunfish Lake BIvd N~W, iThe remaining 4~ acres would be sold to a potential developer for platting when the subject p~pp~y is brought into the Metropolitan Urban Service Area (MUSA). The subject property ist~r~poS~d to be brought into the MUSA with the 1993 comprehensive plan amendment. The following items are enclosed for your review: a) ' Site location map b) Proposed subdivision c) ~ Progosed resolution Observations: The subject Prop~r~y is currently zoned R-1 Rural Residential and is located in the Urban Reserve Area, for'w~0}i thee is a 10 acre minimum lot size. In addition, City Code requires the division of land by PlaRing Iversus metes and bounds descriptions. City Code does provide for the division of land bY metes arid bounds descriptions when platting would cause undue hardship. Mr. Scroggins XVouid like to sell off most of his property, retaining a 5 acre homestead for himself. Mr. Scroggins~:health is such that to require platting at this point would be a hardship for him. Also, the subj~t p~,0perty is forecasted to be brought into the MUSA in 1993 and it is reasonable to expect that Ge $~bject property will be platted, in accordance with City Code requirements, for developmem With ~ban services in the very near future. Recommendation: City Staff recommends approval of the metes and bounds subdivision.
