RESOLUTI~)NiAPPROVING THE DIVISION OF METES AND BOUNDS DESCRIPTION [ introduced the following resolution and moved for its adoption: LAND IN SECTION 23 BY A wHEREAS, Mr. Walter Scroggins applied to the City of Ramsey for a division of land by a metes aad bOUnds description; and WH~RE~kS, Section 9.50.09 of the Ramsey City Code prohibits the division and conveyance 6f la.nB by metes and bounds description; and wHI~REAS, Section 9.50.09 of the Ramsey City Code provides for City Council to waive complianceiwhen compliance will create an unnecessary hardship and failure to comply does not inteffer{~ with the purposes of Chapter 9.50 (Subdivision); and WHEREAS, the subject property is approximately 48.9 acres in size and the applicant desires tO ~jgate a five acre homestead for himself and sell the remaining 43.9 acre parcel for future developmem; and WHERE ~As, the property legally described below is within the City's Urban Reserve Area for which thee is a ten acre minimum lot size: That partier the north half of the Southwest Quarter of Section 23, Township 32, Rang~ 25, ~noka County, Minnesota, lying easterly of ANOKA COUNTY HIG~T~A~Y RSGHT-OF-WAY PLAT NO. 1 and lying southerly of the southerly right- of-way Iirle oftl53rd Avenue N.W. AND.WHEREAS, the property legally described above is proposed to be included in the Municipal Urban Service Area (MUSA) in the City of Ramsey's Comprehensive Plan Amendment for 1993; and WHEREAS, it is anticipated that upon inclusion in the MUSA, the subject property will be platted and!developed in accordance with Chapter 9.50 of the Ramsey City Code.
